HomeMy WebLinkAbout023804 ORD - 10/19/1999ORDINANCE ESTABLISHING A MUNICIPAL COURT TECHNOLOGY FUND; PROVIDING FOR THE ASSESSMENT AND COLLECTION OF A FOUR DOLLAR MUNICIPAL COURT TECHNOLOGY FEE AS A COST OF COURT; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION AND EFFECTIVE DATE OF DECEMBER 1, 1999; AND PROVIDING FOR EXPIRATION DATE OF SEPTEMBER 1, 2005. WHEREAS. the Texas Legislature recently enacted Article 102.0172 of the Code of Criminal Procedure which provides for the establishment of a Municipal Court Technology Fund by ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS: SECTION 1. That the City Code of Ordinances, Chapter 29, Municipal Courts, is amended by the addition of the following section: Sec. 29-50. Municipal Court Technology Fund. (aJ There is hereby created and established a Municipal Court Technology Fund pursuant to Article 102.0172 of the Texas Code of Crimi al Proced re. A defe dant convicted of a misdemeanor offense in municipal court shall pay a four dollar ($4.00) technology fee as a cost of court. This fee does not applyto parking citations. ( For purposes of this section a person is considered convicted if: Cli a sentence is imposed on the person: (2) the person is placed on community supervision including deferred adjudication community supervision. or (31 the court defers final disposition of the person's case. u The municipal court administrator shall collect this cost of court and pay it to the city treasurer. The technology fee so collected shall be deposited in a fund to be known as the municipal court technology fund. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not effect any other section, paragraph, subdivision, clause, phrase, word or provision of this resolution. It is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. This ordinance will be effective on December 1, 1999. SECTION 4. In accordance with Article 102.0172 of the Code of Criminal Procedure, this ordinance and the assessment and collection of the Municipal Court Technology fee expires September 1, 2005. Any funds remaining in the Municipal Court Technology Fund shall continue to be used and administered as required by this ordinance and for that purpose this ordinance remains in effect.
