HomeMy WebLinkAbout023829 ORD - 11/09/1999AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE AN INDUSTRIAL DISTRICT AGREEMENT WITH CITGO REFINING & CHEMICALS, L.P. LANDOWNER AND CORPUS CHRISTI COGENERATION, L.P. AS LESSEE AND IMPROVEMENTS OWNER PURSUANT TO ORDINANCE NO. 022360, EFFECTIVE AS OF DECEMBER 1,1999, AND TO FILE THE AGREEMENT IN THE OFFICIAL RECORDS OF NUECES COUNTY, TEXAS; AND PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, or his designee, is authorized to execute an Industrial District Agreement with Citgo Refining & Chemicals, L.P. as Landowner and Corpus Christi Cogeneration, L.P. as Lessee and Improvements Owner pursuant to Ordinance No. 022360, with this Industrial District Agreement to become effective on December 1, 1999, and to file the Agreement in the Official Records of Nueces County, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance is held invalid or unconstitutional by final judgment of a court of competent jurisdiction it does not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose unless such holding has the effect of diminishing the revenue payable to the City under any agreement entered into under this ordinance. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that t 's ordinance is pssed and shall take effect upon first reading as an emergency measure this the ay of \ OV 111999.
