HomeMy WebLinkAbout023846 ORD - 11/16/1999AN ORDINANCE CLOSING AND ABANDONING AN UNDEVELOPED 22,5000 SQUARE FEET PORTION OF PIRATA DRIVE STREET RIGHT-OF-WAY EAST OF THE PARK ROAD 22 (SOUTH PADRE ISLAND DRIVE) STREET RIGHT- OF-WAY AND WEST OF THE SAND DOLLAR AVENUE RIGHT-OF-WAY, BETWEEN LOT 1A, BLOCK 26, AND LOTS 20A AND 20B, BLOCK 27, PADRE ISLAND NO. 1 SUBDIVISION, SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS AND THE OWNER, VINCENT LEE, REPLATTING THE PROPERTY WITHIN 180 DAYS AT OWNER'S EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there is an undeveloped 22,500 square feet portion of Pirata Drive street right- of-way east of the Park Road 22 (South Padre Island Drive) street right-of-way and west of Sand Dollar Avenue, between Lot 1A, Block 26, and Lots 20A and 20B, Block 27, Padre Island No. 1 Subdivision, as recorded in Volume 13, Pages 1-8, of the Map Records of Nueces County, Texas, that the owner, Vincent Lee ("Owner") wishes to have closed and abandoned; and WHEREAS, there are no public or franchised utilities in this 22,500 square feet portion of street right-of-way; and WHEREAS, in accordance with subdivision (11) of subsection (a) of Section 1 of Article X of the City Charter, a public hearing was held by the City Council after notice by publication and by mail to the last known address of all property owners within four hundred fifty feet of the portion of the street right-of-way proposed to be closed and abandoned; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to close and abandon this street right-of-way for all purposes, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That an undeveloped 22,500 square feet portion of Pirata Drive street right- of-way east of the Park Road 22 (South Padre Island Drive) street right-of-way and west of Sand Dollar Avenue, between Lot 1A, Block 26, and Lots 20A and 20B, Block 27, Padre Island No. 1 Subdivision, as recorded in Volume 13, Pages 1-8, of the Map Records of Nueces County, Texas, is closed and abandoned for public use as a street right-of-way, subject to Owner's compliance with the following specified conditions as part of the closure: 1) That Owner pay the fair market value of $28,125.00 for the closure and abandonment of the 22,500 square feet portion of street right-of-way. H:\LEG-DIR\ V ERONIC A\DOYLE\ORD99. 100\DDCORD99. 104 23846 2) That Owner replat Lot 1A, Block 26, and Lots 20A and 20B, Block 27, Padre Island No. 1 Subdivision, as recorded in Volume 13, Pages 1-8, of the Map Records of Nueces County, Texas, within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional 180 days if extenuating circumstances outside the Owner's control necessitate an extension. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this or 'nance is passed and shall take effect upon first reading as an emergency measure this the i (e of kiey JQ.I' 1999.
