HomeMy WebLinkAbout023857 ORD - 11/30/1999AN ORDINANCE GRANTING A STANDARD SCREENING FENCE EXCEPTION TO COYM, REHMET & GUTIERREZ ENGINEERING ALONG THE SOUTH AND NORTH PROPERTY LINES OF LOT 1, BLOCK 1, BOB LACY'S BUSINESS PARK; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Coym, Rehmet & Gutierrez Engineering for an exception from the standard screening fence requirement in Section 27-3.01.06 of the Zoning Ordinance on Lot 1 (along the south and north property lines), Block 1, Bob Lacy's Business Park, located on the east side of U. S. Highway 77, approximately 900 feet south of Brookhaven Drive; WHEREAS, with proper notice to the public, public hearings were held on Wednesday, October 27, 1999, during a meeting of the Planning Commission, and on Tuesday, November 30, 1999, during a meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi, Texas, during which all interested persons were allowed to appear and be heard; WHEREAS, the City Council finds that there have been no building permits issued upon any lot or lots adjacent to the property of the applicant for construction of any residential structures; and WHEREAS, the City Council finds that no residential structures exist on any lot or lots adjacent to the property of the applicant; WHEREAS, the City Council finds that the waiver of screening fence requirement will not affect adversely the uses of adjacent and neighboring property permitted by this Ordinance; and WHEREAS, the City Council has determined that this exception would best serve public health, necessity, and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The installation of the standard screening fence, required by Section 27-3.01.06 of the Zoning Ordinance, along the north property line of Lot 1, Block 1, Bob Lacy's Business Park, which is located on the east side of U. S. Highway 77, approximately 900 feet south of Brookhaven Drive, is not required because there is an adjacent easement exceeding 200 feet in width for drainage and CP&L which will not be developed. SECTION 2. The installation of the standard screening fence, required by Section 27-3.01.06 of the Zoning Ordinance, along the south property line of Lot 1, Block 1, Bob Lacy's Business Park, which is located on the east side of U. S. Highway 77, approximately 900 feet south of Brookhaven Drive, is not required until such time as a residential building permit is issued on the adjacent property. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 30th day of November, 1999.
