HomeMy WebLinkAbout023865 ORD - 12/14/1999AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A FIFTY-NINE YEAR LEASE WITH CORPUS ASSETS, L.P., TO CONSTRUCT AN AERIAL ENCLOSED PEDESTRIAN BRIDGE OR SKYWALK ACROSS THE ANTELOPE STREET RIGHT-OF-WAY BETWEEN THE AMERICAN BANK BUILDING AND THE FORMER PETROLEUM TOWER BUILDING IN CONSIDERATION OF THE PAYMENT OF $7,440 IN RENT FOR THE FIRST FOUR YEAR TERM, WITH THE RENT FOR SUBSEQUENT FIVE YEAR TERMS BEING ADJUSTED BASED UPON THE CONSUMER PRICE INDEX; AND PROVIDING FOR PUBLICATION. WHEREAS, the installation of the aerial enclosed pedestrian bridge or skywalk (Skywalk) across the Antelope Street right-of-way between the American Bank building and the former Petroleum Tower building will require the installation of' support columns in the sidewalks on both sides of Antelope Street; and WHEREAS, the support columns for the Skywalk will reduce the area of the sidewalks available for pedestrians; and WHEREAS, the installation of the support columns will interfere with the use of the two metered parking spaces adjacent to the columns; and WHEREAS, the support columns on the south side of Antelope Street will violate the "line of sight" requirement in Section 53-260, Visual Obstructions at Street Intersections; and WHEREAS, the intersection at Caranchua and Antelope Streets is controlled by a traffic signal; and WHEREAS, the visual obstruction caused by the support columns is not significantly greater than the visual obstruction caused by an automobile parked at a traffic meter; and WHEREAS, the City Council finds that notwithstanding the reduction in sidewalk area and loss of available metered parking spaces that the installation of the Skywalk support columns will not interfere with the public's use of the street and adjacent sidewalks; and WHEREAS, the City Council finds that notwithstanding the fact that installation of the support columns on the south side of Antelope Street will technically violate the City's Visual Obstruction ordinance the installation of the Skywalk support columns will not create a dangerous condition on the street or sidewalk; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS: R90950C1.doc 023865 2 SECTION 1. That the City Manager, or designee, is authorized to execute a fifty-nine year lease with Corpus Assets, L.P., to construct an aerial enclosed pedestrian bridge or skywalk across the Antelope Street right-of-way between the American Bank Plaza and the former Petroleum Tower Building in consideration of the payment of $7,440 in rent for the first four year term, with the rent for subsequent five year terms being adjusted based upon the consumer price index. A copy of the lease is on file with the City Secretary. SECTION 2. The lease is to begin on November 17, 2000, and will end on November 16, 2059. SECTION 3. Publication will be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
