AN ORDINANCE
AMENDING THE CITY CODE OF ORDINANCES, CITY OF CORPUS
CHRISTI CHAPTER 55, UTILITIES, REGARDING THE ESTABLISHMENT
OF A BUILDER'S INCENTIVE PROGRAM TO PROMOTE THE
INSTALLATION OF NATURAL GAS POWERED EQUIPMENT
THROUGHOUT THE CITY; PROVIDING FOR SEVERANCE; PROVIDING
FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. Chapter 55 ofthe Code of Ordinances is amended by adding new section 55-65 to
read as follows:
Sec. 55-65 Builder's incentive nrOl!:ram
(a) The City Gas Superintendent is authorized to establish a builder's incentive Drogram to promote
the installation of natural t;as Dowered equipment throughout the Citv. The Citv Gas SUDerintendent
is authorized under this program to make pavments in the form of cash. fuel credits. or equipment
to builders. developers. Dropertv owners. and equiDment Droviders who install gas piping and certain
natural gas powered equiDment.
(b) The City Gas Superintendent shall prepare a rebate schedule for the builder's incentive program.
The rebate schedule shall be submitted to the City ManaIJer for apDroval. The approved rebate
schedule shall be filed with the Citv Secretary and cODies shall be provided to the City Council. The
rebate schedule shall be reviewed on an annual basis and mav be adiusted at anv time.
SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or
provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of
competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this City Council that every section,
paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for
its purpose.
SECTION 3. Section 1 of this ordinance is effective upon final adoption by the City Council.
SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi as
required by the City Charter of the City of Corpus Christi.
