HomeMy WebLinkAbout024637 ORD - 10/16/2001 ORDINANCE AMENDING THE CITY CODE OF ORDINANCES, SECTION 29-8, SUBSTITUTE JUDGES, BY AMENDING AMOUNT OF COMPENSATION TO BE PAID TO SUBSTITUTE JUDGES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Code of Ordinances, Section 29-8, is amended to read as follows: Sec. 29-8. Same--Substitute judges. A substitute judge or judges of the municipal courts may from time to time be appointed as provided by the city charter and by state law with the confirmation of city council. The substitute judge or judges may sit as judge in any of such courts or try cases on transfer from any of such courts but shall act as judge of one of such courts only when the regular judge thereof is absent or unable to act for any reason. The substitute judge shall be paid on a daily basis for each day's duty which is performed by him sitting as a judge of the municipal court, and he shall be cntitled ftll each day 5f 3CI . iec (<l bc paid it. thc aluM"'! of 3C . chI) fi, c d<lllal3 ($75.00) a da} paid on a pro rata basis the salary of the regular permanent iudge as determined by the City Manager. Vouchers shall be issued upon certificate of the regular judge certifying that such services were necessary on account of authorized absence or other inability to perform duty. All substitutions shall be subject to approval of the presiding judge. In the event of continuing absence or inability of the judge substituted when the date for payment to the substitute judge becomes due under the city's payroll rules and the voucher for payment has not been issued the presiding judge may issue the same for the substituted judge. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is med and .takes effect upon first reading as an emergency measure this the .J.u2...f'h. day of m4,2001.
