APPROVING A NEW COLLECTIVE BARGAINING
AGREEMENT WITH THE CORPUS CHRISTI FIREFIGHTERS'
ASSOCIATION, SUBJECT TO ACCEPTANCE OF THE
AGREEMENT BY THE COMMITTEE OF PETITIONERS AS AN
ALTERNATIVE SALARY PROPOSAL PURSUANT TO TEXAS
LOCAL GOVERNMENT CODE SECTION 141.034(g)
WHEREAS, the City of Corpus Christi has been engaged in contractual negotiations with
the Corpus Christi Firefighters' Association; and
WHEREAS, the negotiation teams for the City and the Association have concluded
negotiations and have recommended approval of a new collective bargaining agreement (the
"Agreement"), that includes changes which are attached hereto as Exhibit A and incorporated herein;
and
WHEREAS, the Association has informed the City that its membership has approved the
Agreement; and
WHEREAS, on February 27, 2002 qualified voters presented to the City Secretary a petition
to increase firefighter salaries (the "Petition") pursuant to Texas Local Government Code Section
141.034 and the City Secretary on March 6, 2002 certified that the Petition contained sufficient valid
signatures to require an election; and
WHEREAS, the Petition designated a committee of petitioners (the "Committee") pursuant
to Section 141.034(a)(3) comprised of Carlos Torres, Eddie Amaya, Clark McAllister, John
Tanguma, and David Martinez.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS, THAT:
SECTION 1. The City Council adopts the Agreement as its offer of an alternative minimum
salary proposal pursuant to Texas Local Government Code Section 141.034(c)(2).
SECTION 2. The City Manager is hereby authorized to execute the Agreement on behalf
of the City of Corpus Christi, subject to: 1) execution by the appropriate Association officers, and
2) written acceptance of the Agreement by the Committee as an alternative salary proposal pursuant
to Texas Local Government Code Section 141.034(g), substantially in the form set forth in Exhibit
B, attached hereto and incorporated herein.

THE CORPUS CHRISTI FIREFIGHTERS' ASSOCIATION
(AUGUST, 1997 THROUGH JULY, 2000)

The City agrees that in the event that the City provides any wage increase during
the 2002-2003 fiscal year to members of the bargaining unit of the Corpus Christi
Police Department in an amount higher than the three (3) percent adjustment of
November 1, 2002, provided to the members of the bargaining unit of the Corpus
Christi Fire Department, herein, the members of the bargaining unit of the Corpus
Christi Fire Department shall be entitled to the amount over the above 3%. This
provision shall apply to wage increase adjustments only and shall not apply to
any increase granted pursuant to a petition initiated pursuant to State statue.
This provision shall be considered a one-time agreement covering FY 02-03 only
and shall not extend beyond July 31, 2003.
Article XVl, Section 1, Duration, is amended to hereafter read as follows:
This agreement shall be effective as of date of signing and shall remain in full
force and effect until July 31, 2003 and thereafter until superseded by a new
contract.

ACCEPTANCE

negotiations and have recommended approval of a new collective bargaining agreement (the
"Agreement"); and
WHEREAS, the Association has informed the City that its membership has approved the
Agreement; and
WHEREAS, on February 27, 2002 qualified voters presented to the City Secretary a
petition to increase fimfighter salaries pursuant to Texas Local Government Code Section 141.034
(the "Petition") and the City Secretary on March 6, 2002 certified that the Petition contained
sufficient valid signatures to require an election; and
WHEREAS, the Petition designated a committee of petitioners (the "Committee") pursuant
to Section 141.034(a)(3) comprised of Carlos Torres, Eddie Amaya, Clark McAllister, John
Tanguma, and David Martinez; and
WHEREAS, the City Council ofthe City ofCorpus Christi on March 19,2002 adoptedthe
Agreement as its offer of an alternative minimum salary proposal pursuant to Texas Local
Government Code Section 141.034(c)(2); and
WHEREAS, the Committee has determined that the City Council's alternative minimum
salary proposal should be accepted, and that the City Council should not call an election pursuant to
Texas Local Government Code Section 141.034.
NOW, THEREFORE, PREMISES CONSIDERED:
Pursuant to Texas Local Government Code Section 141.034(g), the Committee accepts the
City Council's alternative minimum salary proposal as reflected in the Agreement.
