HomeMy WebLinkAbout024940 ORD - 07/09/2002 AN ORDINANCE AMENDING SECTION 12-2 OF THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, REGARDING PLACING OBSTRUCTIONS IN CORPUS CHRISTI BAY; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1, Section 12-2, Code of Ordinances, is revised to read as follows: "Sec.12-2. Placing obstructions in Corpus Christi Bay. ".illlJt shall be unlawful for any person to place or cause or permit to be placed; any post, stake, wharf, pier or piling or any obstruction of any character whatsoever in the waters of Corpus Christi Bay within the city; without first having obtained permission from one of the followina officials: "(1) City Council in the case of the installation of a new wharf or pier within the Corpus Christi Marina, "(2) Marina Superintendent in the case of the installation of anv post. stake, wl:larf, Bier or pilina or any obstruction or the repair or replacement of a wharf or pier within the Corpus Christi Marina. "Q.t-(3) Petroleum Superintendent in the case of the installation of anv post. stake, wharf, pier or pilina or any obstruction that is related to an oil or aas facility. "fdt-(4) City Manaaer, or the City Manaaer's desianee, in all other cases, "(b) Before arantina permission, the official shall determine whether the applicant has obtained any reauired permits or authorizations for the installation from the Texas General Land Office, U. S. Armv Corps of Enaineers. and U, S. Coast Guard. "(c) In addition, the applicant must submit plans and obtain a buildinQ permit for the installation of any post. stake, wharf. pier or pilino or any obstruction from the Building Official under Sections 13-1 and 13-2 of this Code, "(d) An applicant may appeal the denial of permission bv an official listed in subsection (a)(Z), (3) or (4) of this section to install anv post. stake, wharf, pier or pilina or any obstruction in Corpus Christi Bav to the City Council tAerofor." SECTION 2. Iffor any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the R22705A3 024940 2 definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision of this ordinance be given full force and effect for its purpose. SECTION 3. A violation of this ordinance or requirements implemented hereunder shall constitute an offense, punishable as provided in Section 1-6 of the City Code of Ordinances. SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
