Under Corpus Christi City Charter Article X, Section l(a)(12) and Texas Transportation Code Chapter 313, tl:: city council determines that it is necessary to improve and orders the improvement of the follox ,'ing highway in the city: Brookdale Street Improvements from Gollihar to Sunnybrook and Whiting Sidewalk Improvements from Churchill to Lataier. As specified in more detail it~ Project plans and specifications, the Brookdale/Whiting Street Improvements/Sidewalk Project will include: 1. filling, grading, lowering, pa[ring, or repairing the streets in a permanent manner; 2. widening the streets to 28 and 36 feet back of curb to back of curb; 3. constructing and realigning qurbs, gutters, and sidewalks; and 4. constructing driveways. For purposes of this resolution, "highway" includes any part of a street, alley, public place, or square including a part left wholl5'' or partly unimproved in cormection with another street improvement. SECTION 2. The Project consists of three categories of improvements: a) street, curb, gutter, and sidewalk improvements Jo be paid for partly by the city and partly by assessments; b) driveways to be paid for entirely by ~assessments; and c) other improvements, to be paid for by the city, because either the assessment statute does not apply to these improvements or the city is not making assessments to pay for them. An assessment against abutting property or affected railway property will create a lien ora the property and a personal liability and charge against the INDEXED property owner. If the property is exempt from a street improvement assessment lien when the improvements are ordered, then no assessment lien will be created. The owner of the exempt property, however, will be personally liable for an assessment in connection with the property. An owner of exempt property may voluntarily execute a Builder's and Mechanic's Lien Contract and Note to place a lien on the property. SECTION 3. To ensure that assessment liens take effect as soon as possible, and to ensure that the liens will apply to the fullest extent even if assessed property is subdivided or sold, the director of engineering services will file a notice of the proposed assessments with the Clerk of Nueces County, Texas. This notice will describe, or describe by reference, each parcel of property abutting the proposed improvements and affected railway property, if any. I have experience in appraising both commercial and residential properties, and I am familiar with the real estate market in Corpus Christi. I am familiar with the Brookdale Street Improvements and Whiting Sidewalk hnprovements. I agree with Mr. JeffBarroso's description of the conditions to be changed and I am familiar with the improvements to bo made by the City of Corpus Christi. I have reviewed the project assessment roll; and personally examined each of the 78 parcels of land therein. In my opinion each such parcel will be specifically benefited by each improvement to bo assessed against it; without regard to the community benefit. In addition, it is my opinion that each such parcel will bo specially enhanced by such improvement at least to the extent of the assessment stated. Escobar. I am the City Engineer for the City of Corpus Christi and have served in this capacity for the last 26 months and as Assistant City Engineer for the last one hundred twenty months (120) months. I am a Professional Engineer, licensed by the State of Texas since 1977. I have over 24 years of experience in design of construction and estimating the costs thereof. I am familiar with this project, which encompasses: · Brookdale Drive from Gollihar Road to Sunnybrook · Whiting from Churchill to Lanier This project consists of construction of 1,250 linear feet of 28-foot back-to-back pavement, sidewalks, driveways, 560 linear feet of storm sewer, 1,190 linear feet of sanitary sewer and 1,560 linear feet of water line together with all appurtenances as shown on the plans and called for in the specifications. Limits of the work will be as follows: · Brookdale Drive from Gollihar Road to Sunnybrook · Whiting from Churchillto Lanier Funds to finance the proposed project are available in the Utilities Commercial Paper Program. Prior to this hearing, I had an estimate of project costs prepared, and it compared favorably with the bids received. In my opinion, the costs are true and accurate.
