EXECUTE A USE PRIVILEGE AGREEMENT WITH OAKHURST LTD,
A TEXAS LIMITEI) PARTNERSHIP, FOR THE RIGHI 10 OPERATE,
CONSTRI!(T', MAINTAIN AND REMOVE A 2.87' WIDE BY 60' LONG
BUILDING EXTENSION WITH OUTBACK STEAKHOUSE OF
ItOUSTON-II, LTD, A /'EXAS LIMITED PARTNERSHIP, OVER
PUBLIC STREET RIGIIT-OF-WAY ADJACENT TO THE EXISTING
iIUILDING LOCATED AT 4221 S()IiTH PADRE ISLAND DRIVE;
ESTABLISHING A FEE OF $2,080; AND OTHER SPECIFIED
CONI)ITIONS; AND DECLARING AN EMERGEN( Y.
WHEREAS, m order to satisl~ the requirements of Chapter 316 Texas Transportation Code, the

a hazardous condition or obstruction of ,.ehicular or pedestrian travel on Oakhurst Drive or the

WHEREAS, tile City Council finds that thc design and location of the building extension
includes all reasonable planning lo minimi×e potential injur3 or interference to the public itl the
usc of ()akhurs! l)rixe and the a4iacem sidewalk: and
Wit EREAS, thc CiLx Council finds lhat the use of thc bnilding extension will not interfere with
thc public nsc of Oakhurst [)rix e or ac[iacenl sideu, alk: and
WHEREAS, thc City Council finds that the use of tile building extension will not create a
dangcrons condition on Oakhurst I)rix e or lhe a4jacent sidewalk:
NOW, TIIEREFORF, BE IT ORI)AINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS, TttAT:
SECTION 1. That the ('it3 Manager, or his designee, is hcrcb3 authorized to execute a usc
prixilcgc agreement with Oakhurs! ltd.. a Texas lilnitcd partnership, lbr the right to construct,
install, operate, maintain and remo',e a building extension approximately 2.87' in width, by 60~
itl length. '~xilh ()utback Sleakhonsc of Honston-[l. l.td. a Icxas limited partnership, within a City
public ri~ht-ot2v~a} adjacent lo thc existing bnilding located at 4221 South Padre Island [)rive.
SECTION 2. I hat Oakhurst l.td., az I'cxas limited parmcrship, comply ~ith the terms and
conditinns of thc use privilege agreement, a copy of xxhich is on fi lc with the City Secretary. and
be subject lo the following conditions as part of the use privilege agreement:

I Slaff recommends pa} mom of a fee of $2.080 for tile usc privilege agreement.
l'he building exlension ~ill extend approximatel3 2.87' in width by 60' in length
occupying approximately 172-square feet of tit3 public right-of-x~ay.
()akhurst l,td., a lexas 15mired Pm'mership, will be held solely responsible for all
opcratiou, mamtenaucc, and removal of thc improxements. ,An engineering permit will
be rcqnircd for any future repairs to tile bnilding cxteusion describcd in the use privilege
agreement.
I'hc sanitarx sex~er scrxing thc ()utback Steakhoosc Restauraut will become a private linc
to be maintained by the propcrt3 ox~ner.
SECTION 3. fha! opoo writlcn request of the Mayor or five couucil members, copy attached,
the ('ily Council (I) finds and declares an emergency duc to the need lbr immediate action
necessary lbr tile el'ficicut and el'Ikcli;e administration of City affairs and (2) suspends the
Charier rule thai requires consideration of and voting upon ordinances at two regular meetings so
that this ordinance is passed and takes ct'l'ect upon firsl reading as an emergency measure this tile

For the reasons set lbrth m the emergenc5 clause nf thc lbregoing ordinance, an emergency
exists rcqniring suspension of tile Charter rnlc as to consideration and voting upon ordinances at
t'~xo regular meetings: l/We. therefore, request that you suspend said Charter rule and pass this
ordinance finally on Ihe date it is inm)duced, or at the present meeting of the City Council.
