COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. Section 21-47 of th~ Code of Ordinances, City of Corpus Christi, is
revised to read as follows:
"Section 21-47 (b)(1). Municipal Solid Waste System Service Charge.
"(1) For customers located within the city, who are billed by their permitted solid
waste hauler for hire by tonnage, ithe municipal solid waste system service charge is

($14.85) per ton of waste.
"(2) For customers located witl~in the city, who are billed by their permitted solid
waste hauler for hire by the volu~e of the dumpster and frequency of service, the
municipal solid waste system service charge is forty six cents ($0.46) sixty cents
($0.60) per cubic yard of capacity each time the customer's dumpster is serviced.
"(3) For customers located within the city, who are billed by their permitted solid
waste hauler for hire by tonnage, iif their permitted solid waste hauler for hire has a put
or pay contract with the city and disposes the customer's solid waste at a disposal site
operated by the department, the tnunicipal solid waste system service charge will be
credited w~th .................. Jr ......... ~ .....~,.kqht dollars and thirty-five cents
($8.35) for the portions of the charge that are collected through the hauler's
acceptance fee. The municipal s~lid waste system service charge, with the credit, is
~six dollars and fifty cents ($6.50) per ton of waste.
"(4) For customers located witl~in the city, who are billed by their permitted solid
waste hauler for hire by the volur~e of the dumpster and frequency of service, if their
permitted solid waste hauler for I~ire has a put or pay contract with the city and disposes
the customer's solid waste at a dlsposal site operated by the department, the municipal
solid waste system service chargff will be credited with ~twenty one
cents ($0.21) for the portions of the charge that are collected through the hauler's
acceptance fee. The municipal s~olid waste system service charge, with the credit, is
t~thirty-nine cents ($0.39) per cubic yard of capacity each time the
customer's dumpster is serviced.
"(5) For customers within the c~ity, who are billed by the permitted solid waste hauler
for hire by tonnage, if their permi~ed solid waste hauler for hire pays the tipping rate
published in section 21-41(e)(2)ai., the municipal solid waste system service charge will

three cents ($13.33) for the portiqns of the charge that are collected through the tipping
fee. The municipal solid waste s~stem service charge, with the credit, is ~

as provided in subsection (d) of this section, if the hauler pays the tipping fee at the time
the hauler disposes of the solid v~aste, the municipal solid waste system service charge
must be paid at the time the hauler disposes of the solid waste at the disposal site
operated by the department.
"(6) For customers within the clty, who are billed by the permitted solid waste hauler
for hire by the volume of the dumpster and frequency of service, if their permitted solid
waste hauler for hire pays the tipping rate published in section 21-41 (e)(2)a., the
municipal solid waste system serVice charge will be credited with ~

six cents ($1.86) per month (whi(~h includes the city street use fee)."
SECTION 2. A violation of any oi the provisions of this ordinance constitutes an
offense, punishable as provided in Section 21-3 of the Code of Ordinances.
SECTION 3. If for any reason ar~y section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance shall be held invalid or unconstitutional by final
judgment of a court of competen~ jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the
definite intent of this City Councillthat every section, paragraph, subdivision, clause,
phrase, word or provision of this Ordinance be given full force and effect for its purpose.
SECTION 4. This ordinance is effective on August 1, 2003.
SECTION 5. Notice of this ordinance shall be published in the official publication of the
City of Corpus Christi as requiredby the City Charger of the City of Corpus Christi.
SECTION 6. That upon written irequest of the Mayor or five Council members, copy
attached, to find and declare ~n emergency due to the need for immediate action
necessary for the efficient and ~ffective administration of City affairs, such finding of
an emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upor1 ordinances at two regular meetings so that this
ordinance is pass~ ~nd shalI take,<¢ffect upon first reading as an emergency
