HomeMy WebLinkAbout025403 ORD - 07/22/2003AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, CHAPTER 21, GARBAGE, TRASH, ANI~ OTHER REFUSE TO INCREASE, IN CERTAIN INSTANCES, THE SOLID WASTE HAULER ANNUAL PERMIT FEE; PROVIDING FOR PENALTIES, PROVIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY!COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Section 21-85 of the Code of Ordinances, City of Corpus Christi, is revised to read as follows: "Section 21-85 Fees for Solid Wa~ste Hauler Permits. "(a) The annual fee for a solid ~Naste hauler for hire permit, for a solid waste hauler for hire, is one hundred dollars ($109.00), payable to the City at the time of issuance of solid waste hauler for hire permit~ "(b) The annual fee for a solid Waste self hauler permit, for a solid waste self hauler is fifty dollars ($50.00), payable to the City at the time of issuance of solid waste hauler permit. "(c) The fee for a solid waste I~auler for hire found transportin.q, collectin.q, or disposin.q of solid waste within tl~e City without a valid permit is two hundred dollars ($200.00), payable to the City at,he time of issuance of solid waste hauler for hire permit. "(d) The fee for a solid waste ~elf hauler found transporting, collecting, or disposing of solid waste within the City withou~ a valid permit is one hundred dollars,!$100.00), payable to the City at the time of issuance of solid waste hauler permit. "(e) Any solid waste hauler fo~ hire or solid waste self-hauler may be denied access to any City disposal site and ma~ be issued a citation for failure to have a valid permit." SECTION 2. A violation of any oI the provisions of this ordinance constitutes an offense, punishable as provided in Section 21-3 of the Code of Ordinances. SECTION 3. If for any reason a0y section, paragraph, subdivision, clause, phrase, word or provision of this ordinan(~e shall be held invalid or unconstitutional by final judgment of a court of competen~ jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, I~hrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision of this t~rdinance be given full force and effect for its purpose. SECTION 4. This ordinance is e~ective on August 1, 2003. SECTION 5. Notice of this ordinance shall be published in the official publication of the City of Corpus Christi as requiredl by the City Charger of the City of Corpus Christi. SECTION 6. That upon written ~'equest of the Mayor or five Council members, copy attached, to find and declare ap emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and dec;lared requiring suspension of the Charter rule as to consideration and voting upor~ ordinances at two regular meetings so that this ordinance is passed ~and shall take effect upon first reading as an emergency measure this the ~ day of ! .~_'~b~ ,2003.
