HomeMy WebLinkAbout025709 ORD - 04/13/2004AN ORDINANCE AMENDING THE PLATTING ORDINANCE OF THE CITY OF CORPUS CHRISTI BY REVISING SECTION Xl- PENALTIES, BY CHANGING THE MAXIMUM FINE AMOUNT FROM $100.00 TO $500.00; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the amendment of the Platting Ordinance of the City of Corpus Christi; WHEREAS, with proper notice to the public, public hearings were held on Wednesday, February 25, 2004, during a meeting of the Planning Commission, and on Tuesday, March 30, 2004, for the first reading and on Tuesday, April 13, 2004, for the second reading, during a meeting of the City Council, in the Council Chambers, at City Hall, in the City of Corpus Christi, during which all interested persons were allowed to appear and be heard; and WHEREAS, the maximum penalty amount of $500.00 for the Platting Ordinance is reflective of the maximum amount allowed for municipalities in Section 54 of the Local Government Code for code violations of this type; and WHEREAS, the City Council has determined that this amendment would best serve public health, necessity, and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI; SECTION 1. That Section Xl of the Platting Ordinance of the City of Corpus Christi is revised to read as follows: SECTION Xl - PENALTIES. A_. Violation of any provision or provisions of this Ordinance by any subdivider shall constitute a misdemeanor and upon conviction of such violation in the Municipal Court of the City of Corpus Christi, a fine not exceeding eRe-five hundred dollars ($!00.00) ($500.00) shall be imposed, and each day that such violation continues shall be a separate offense. In case a corporation is the violator of any provisions of this ordinance, each officer, agent, and/or employee in any wise responsible for such violation thereof shall be individually and severally liable for the penalties herein prescribed: C. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
