HomeMy WebLinkAbout025744 ORD - 05/11/2004ORDINANCE AUTHORIZING THE RESALE OF NINETY-ONE (91) PROPERTIES SHOWN ON THE ATTACHED AND INCORPORATED EXHIBIT A WHICH WERE FORECLOSED UPON FOR FAILURE TO PAY AD VALOREM TAXES AND MISCELLANEOUS LIENS, FOR MINIMUM OPENING BIDS EQUAL TO PRICES LISTED ON THE ATTACHED EXHIBIT A; AND DECLARING AN EMERGENCY WHEREAS, the taxing authorities hold in trust the ninety-one (91) properties legally described on the attached and incorporated Exhibit A; WHEREAS, the ninety-one properties were struck offto the taxing authorities over six months ago and have no offers pending; WHEREAS, the taxing authorities desire to obtain the best possible price for the properties and retum these properties to the tax rolls; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That pursuant to Section 34.05 of the Tax Code, the governing body of the City of Corpus Christi authorizes the resale of ninety-one (91) properties shown on the attached and incorporated Exhibit A, which were foreclosed upon for failure to pay ad valorem taxes and miscellaneous liens, at a tax sale public auction, for minimum opening bids listed on attached Exhibit A. SECTION 2. That should any of the properties listed on Exhibit A not sell at the tax sale auction, then the goveming body of the City of Corpus Christi authorizes the resale of such property at tax sale public auction for revised minimum opening bid of one-half of minimum opening bid listed on Exhibit A. SECTION 3. The Nueces County Judge is authorized to execute a resale deed upon payment to the City for the City's share of the tax resale proceeds. SECTION 4. That upon written request of the Mayor or five Council members1 copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings_so that this (~ldinance is passed and takes effect upon first reading as an emergency measure this the I ('~'-day of ,/~/~1 ,2004.
