HomeMy WebLinkAbout025846 ORD - 07/20/2004ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE TO EXECUTE AN AIRLINE USE AND LEASE AGREEMENT WITH AMERICAN EAGLE AIRLINES, INC., ATLANTIC SOUTHEAST AIRLINES INC, EXPRESS JET AIRLINES, INC., AND SOUTHWEST AIRLINES COMPANY FOR USE OF SPACE AT CORPUS CHRISTI INTERNATIONAL AIRPORT IN CONSIDERATION OF PAYMENT OF FEES THAT TOTAL APPROXIMATELY $5.94 PER ENPLANED PASSENGER AND ARE ADJUSTED ANNUALLY BASED ON A FIXED FORMULA, FOR A TERM OF UP TO TVVELVE MONTHS; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manger, or his designee, is hereby authorized to execute an Airline Use and Lease Agreement with American Eagle Airlines, Inc., Atlantic Southeast Airlines, Inc., Expressjet Airlines, Inc., and Southwest Airlines Company for use of space at Corpus Christi International Airport in consideration of payment of fees that total approximately $5.94 per enplaned passenger and are adjusted annually based on a fixed formula, for a term of up to twelve months. SECTION 2. Publication will be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 3. That upon written request of the May or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is pas ,~d a~.d takes effect upon first reading as an emergency measure this the ~rK"day of ~/~'J'~l ' 2004. u !
