HomeMy WebLinkAbout025869 ORD - 07/27/2004AN ORDINANCE REVISING SECTIONS 23-$7(3)(b), 6-23{j), and 19-33(b), CODE OF ORDINANCES, TO INCREASE HEALTH DEPARTMENT FEES RELATING TO POOL INSPECTIONS, RABIES TESTING, AND FOOD ESTABLISHMENT HEALTH PERMITS; PROVIDING FOR SEVERANCE; PROVIDING FOR PENALTIES; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. Section 23-57(3)(b), Code of Ordinances, is revised to read as follows: "Sec. 23-57. Swimming pool standards. "The following rules pertaining to swimming pools sha~be are in full force and effect: "(3) Inspections; fee. "(b) Inspection fee. An annual inspection fee of fifty dollars ($50.00) one hundred dollars ($100.00), payable on or before April 1 of each year, sh=!! must be paid for each property swimming pool. The direc- tor of public health shall establish procedures for collecting .... the fee. No person sh2!! may operate a property swimming pool unless the pool's annual inspection fee is currently has been paid. Each day of operation in violation of this section shall constitute constitutes a separate offense." SECTION 2. Section 6-23(i), Code of Ordinances, is revised to read as follows: "Sec. 6-23. Animals biting =nd!ct o~r exhibiting symptoms of rabies. "(i) Ownorto pay costs. Payment of costs. The owner of an animal quarantined under this section shall pay to the animal control supervisor the reasonable costs of tho quar antine and disposition of the animal, including charges for shipment of the animal's head or brain, if required, to the nearest Texas Department of Health laboratory for test lng. The owner shall pay to thc animal control supervisor a fee of eight dollars ($8.00) for preparation of each animal head for shipping to the state department laboratory for rabies tatting. Where the owner of a nonquarantined animal is required to or requests that the head or brain of the animal be shipped to an appropriate lab, then the owner shall be responsible for paying costs of preparation and shipping. "(1) The owner of an animal quarantined under this section shall pavto the animal control supervisor the reasonable costs of the Quarantine and disDosi- tion of the animal, includinq charqes for preparation, processinq, and ship- ment of the animal's head or brain, if recluired, to the nearest Texas Depart- ment of Health laboratory for testinq. The fee for preparation, processincl, and shipment, bv the animal control supervisor, of the animal's head or brain is seventy-five dollars ($75.00). "(2) The owner of a non-Quarantined animal or a veterinarian, if required by law or upon the owner's or a veterinarian's recluest, may seek the services of the animal control supervisor to prepare, process, and ship the head or brain of an animal to the nearest Texas Department of Health laboratory for testincl. If the head or brain is prepared by a veterinarian for processinq and shipment by the animal control supervisor, the person requestinq the service shall pay a fee to the animal control supervisor of fifty dollars ($50 00). If the head or brain is prepared by the animal control supervisor for processincl and shipment, the person requestin~l the service shall pava fee to the animal control supervisor of seventy-five dollars ($75.00)." SECTION 3. Section 19-33(b), Code of Ordinances, is revised to read as follows: "Sec. 19-33. Issuance; fee. If, for any reason, any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance is held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it will not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of the City Council that every section, paragraph, subdivision, phrase, word, and provision of this Ordinance be given full force and effect for its purpose. SECTION 5. A violation of this ordinance or the requirements implemented under this ordinance constitutes an offense punishable under Section 16 of the Code of Ordinances. SECTION $. Publication of this ordinance is to be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi, Texas. SECTION 7.
