"10" ISLAND OVERLAY DISTRICT, TO ESTABLISH A UNIQUE ISLAND DEVELOPMENT STANDARD; AND BY REVISING ARTICLE 1:3 "B2-A" BARRIER ISLAND BUSINESS DISTRICT, SECTION '13-2 USE REGULATIONS, TO INCLUDE NEW USES AND USE REQUIREMENTS; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION, AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the amendments of the Zoning Ordinance of the City of Corpus Christi and Zoning Map; WHEREAS, with proper notice to the public, public hearings were held on Wednesday, July 14, 2004, dudng a meeting of the Planning Commission, and on Tuesday, August 17, 2004, during a meeting of the City Council of the City of Corpus Christi, during which all interested persons were allowed to appear and be heard; WHEREAS, the City Council has determined that these amendments would best serve public health, necessity, and convenience, and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by adding Article 13A. "10" Island Overlay District, to read as follows: ARTICLE 13A- "10" ISLAND OVERLAY DISTRICT REGULATIONS Section 13A-1 Declaration of Public Policy and Purpose. The Island Overlav requlations are to promote quality development on Padre Island as viewed from public riqhts-of-wav as indicated on the attached map. This district is desiqned to create a distinctive quality of life of the area by promotincl buildincl desiqn characteristic of a resort area. These special requlations will preserve the characteristic nature of a barrier island of scenic and economic importance to the City. 13A-1.01 The City encouraqes the use of Planned Unit Development requlations when any development in the Island Overlay district proposes qualm not anticipated in these requlations of a quality at least equivalent to those specified herein. 13A-1.02 Except as provided by Section 13A-8, this district prohibits outdoor storaqe of any ¢~oods. Section 13A-2 Use Reclulafions. Refer to base zoninq district except as provided herein. Augus[ 11, 2004 Section 13A-3 Parkin¢l Rel3ulafions. The parkinq requlations for permitted uses are contained in Article 22. It is the intent of this section to encoura.qe parkinq to the rear or side of businesses to promote storefronts adiacent to Park Road 22~ and S.H. 361~ 13A-3.01. Owners that elect to place 100% of the required on-site parkinq behind the buildin,~ will receive a 10% credit on the total site parkinq requirements. 13A-3.02. Decorative brick, stamped, concrete pavers or the equivalent must be used as an entry feature for the pedestrian access areas within the setback area in the entry driveway to the front buildinq line. Color schemes are to be submitted for review and approval to the City. Any color used to meet health and safety reauirements are exempt from City approval for those areas. Parkin.q areas must be constructed under specifications and construction standards provided by the City. Section 13A-4 Off-Street Loadin~l Regulations. The off-street Ioadinq requlafions for permitted uses are contained in Article 23. Section 13A-5 Hei~lht and Area Re~lulations. 13A-5.01. The maximum heiqht and maximum area re(~uirements are set forth in the chart of Article 24, and in addition, the followinq re(~uirements apply: 13A-5.02. No buildinq is permitted in front yard area. 13A-5.03. Any use developed or used for townhouses or multi-family development shall have a frontyard setback not less than ten (10) feet. Sec~on 13A-6 Sul3plementarv heiclht and area re.qulations. Supplementary height and area requlations are contained in Article 27, Section 13A-7 Access Restrictions. 13A-7.01. No business may access any local residential street unless it is the only means of access to the property. 13A-7.02 Shared Access and ParkinQ. All undeveloped tracts used for business may share parkin~:l and access with adioinin(~ tracts. The election to share parkinq or access must be noted on the plat or buildincl permit for the tract to be developed. Any such "shared access" agreement between property owners shall be evidenced by easement or document filed for record as a covenant that is transferable with title Park Road 22 is/he Texas Department of Transportation's desiqnation for South Padre Island Drive. August11,2004 2 13A-7.03. to the property. Nothinq in this provision shall be interpreted as authofizinq the City of Corpus Christi to deny access to any property when such access otherwise meets all requirements of driveway standards established bv ordinance applicable to proposed use of property. Pedestrian seating areas and amenities includinq transit facilities integrated aloncl street front sides of buildinqs on private propertv mav receive a credit toward parkinq requirements at a ratio of one square foot of such amenity area will be credited toward one square foot of a parkinq space. The minimum total amenity is 162 square feet to realize a one parkinq space credit. A. Amenity areas must consist of all weather chairs and tables that complement the desiqn and color pattern of the buildin¢l. Amenity areas must include shade from trees and awninqs and mav include public art, a water feature and potable water for pedestrians. A sidewalk restaurant may be inteqrated into the desiqn of the amenity provided that access and seatinq is provided for non- customers. Section 13A-8 13A-8.01. 13A-8,02. 13A-8.03. Screenin~ Reauirements. Alonq collector or local streets, multifamilv and non-residential uses that back or side on sinqle-familv residential properties or zoninq districts must have a six foot solid screeninq wall constructed of brick, masonry, stucco or vinvI alon~ the property line of such boundary or boundaries. A six foot screeninq wall similar to or complementary with the color of the finish on the buildinq shall be required to screen the followinq uses from public riqhts-of-wav: A. Boat and RV storaqe. B. Mini-storaqe. C. Areas used for outdoor sales, service, storaqe, and display allowed in this Article, must be screened from view of public riqht-of-wav by a six foot hiqh wall. Dumpster and other trash containers and collection areas must be screened bva wall, at least 6 feet in heiqht, with a finish similar to that August 11, 2004 13A-8,05. Section 13A-9 13A-9.01. 13A-9.02. of the buildinq. Screeninq of the open end of the dumpster enclosure must be accomplished by orientation of the enclosure and by providinq a solid wooden self closinq ~late. Mechanical equipment located on the roof must be screened from view of adjacent properties by a parapet wall or pitched roof. Mechanical equipment on the qround must be screened by a wall with a finish similar to that of the buildinq. Landscapin~l ReCluirernents. Extensive landscapinq is reauired to provide a lush landscape. All landscapinq is to be maintained in a healthy, ¢~rowinq condition. Except as provided in this section, the landscapinq requirements are in Section 27B-7.01C apply. The use of drou~lht tolerant plant species is encouraqed in this district. A. Tracts, lots, or reserves that are developed within the Island Overlay District must have 10 percent site landscapinq of the total qross site area. B. Permitted siqns may be placed in any landscape area adiacent to street dqhts-of-way so Iona as the siqnaqe does not obstruct the visibility trfanclle area of any streets or driveways. C. Driveway entrances within required frontvard setbacks (and side yard setbacks alonq side streets) and constructed of pavers, stamped concrete, and other equivalent pavement textured material may be calculated as landscape area. The maximum area credit for textured driveway entrances is limited to 15% of the total required landscape area. D. For properties abuttJnq Park Road 22 or S.H. 361, palm trees with a minimum crown heiqht of eiqht feet must be planted and spaced on 30 foot centers five feet inside the private property line. E. Artificial plants may not be used to satisfy the requirements of this section. Minimum Landscapinq Specifications. A. If a berm is provided, side slope must not exceed a maximum of 4:1 on three sides. One sheer side may be provided. B, Landscape material specifications. 1. Palm trees must be a minimum crown heiqht at installation of eight. August 11, 2004 4 Shrubs must be a minimum of eiclhteen inches in heiclht at installation and maintained at no more than 3 foot overall height. 13A-9.03 Recommended plant species list - See Appendix A Section 13A-10Sign Recluirements. 13A -10.01. Purpose. This section provides uniform SiCln standards which promote the safety of persons and property, provide for the efficient transfer of information in sicln messaqes, and to protect the public welfare bv enhancin~l the appearance and economic value of the landscape. Sicln - means any device, liclht, ficlure, picture, letter, word, messac~e, symbol, placlue or poster visible from outside the premises on which it is located and desiclned to inform or attract the attention of persons not on the premises. B. Window Siqnacle - may include siclns located inside a buiidincl if visible to off-premises public. 13A-10.02. Desicln standards. All permanent siclns must meet the followinq standards: A. Measurements of siqn area. 1. Wall siqns. The sicln facinq or surface area of a wall siqn must be computed as Jncludincl the entire area within a reclular cleometric form compdsinq all display area of the si.qn includincl all elements of the displav and the fTame, if applicable. Wall siclns are permitted for each individual business establishment, includin.~ individual businesses within inteclrated business developments, with an allowable total siqn area of one and two tenths (1.2) scluare feet of siqnacle for each linear foot of business frontaqe. Wahl si.qna~le shall be uniform in color, style, materials, and illumination, and shall be similar in method of construction and installation. Lettedn¢~ shall be uniform in location, heiclht and depth, and consistent in color. 2. Monument siclns. August 11, 2004 5 a. A siqn which is supported by one monolithic structure set upon the qround and is not a part of a building. The sign facinq or surface area must be computed within a reqular geometric form comprising all displav area of the siqn and including the elements of the matter displayed as well as the frame. The sign area of a monument sign must be centered within the frame, and the frame and base must be proportional to the siqn area. Except as provided herein, a monument sign must be constructed so that the bottom is no higher than two (2) feet above the adjacent grade. The top of the monument siqn must be no higher than eight feet as measured from natural or average finished grade, The maximum overall square footage for a monument sign is 32 sguare feet. d. One monument sign per freestanding building and one (1) additional monument siqn per 200 feet of street frontaqe. Monument signs are to be finished with similar materials to structure and should reflect the desiqn theme of the building stile. Structural members. Supportinq structural members not bearinq advertising matter, identifying color symbols, wordinq, or pictures mav not be included in computation of surface area. Irregular signs. In calculating the area of irregular signs or separately mounted sjgrls on one supporting structure, the area must be that of the smallest regular geometric form that will wholly contain all of the elements including the frame. Multi-faced siqns. In calculating the area of multi-faced signs, all faces of a multi-faced sign must be included in the total sign area calculation. Sign spacing. When a sign is placed at an angle to the intersection of two streets, measurement for spacing purposes must be from the edqe or side farthest from the intersection. 7. The total area of the surface of a three dimensional sign must apply toward the allowable sign area. Such surface area must be computed within one or more regular geometric forms as necessary to determine the total proposed sign area. August 11, 2004 6 13A-10.03. Prohibited siclns. The followinq signs or types of sit, ns are prohibited: A. Billboards. Siqns which advertise or otherwise direct attention to an off- premises products, services, activities, persons, institutions, or businesses; to businesses that no Ionaer occupy a structure on the property; or to products, services, or activities that are no longer conducted, sold, manufactured, produced, or offered upon the premises where the siqn is displayed. C. Roof mounted siqns or any siqn that proiects above the eave of a pitched roof or deckinq of a fiat roof or parapet above a fiat roof. Siqn Statuary - Life size or larger than life size replicas of animals, fish, or inanimate objects intended to be used as a commercial message. E. Window Siqns in excess of 10% of the ¢llass area per wall facade. 13A-10.04. Exceptions. A permit is not required for the followinq, however other subsections of this Section apply as applicable: A. The maintenance of the siclns electrical system, repainting, cleaninq, or other maintenance of a siqn. B. Placement of temporary on premise real estate siqns for vacant lots in platted subdivisions. C. Placement of temporary on premise contractor identification siqns. Placement of temporary on premise monument vacant land sale siclns qivinq information concerning leasinq, rentine, or selling of property in the district. 13A- 10.05. Definitions. Except as provided in this subsection, the definitions contained in Article 3 apply to this section. Amenity: A landscaped area that is available to the qeneral public that is outdoors and adjacent to and inteqral to a commercial buildinq or buildinqs, includinq, but is not limited to, seafincl, shade, artwork, a water feature and sanitary facilities. Business frontaqe: The linear measurement from outer wall to outer wall of the side of the building which faces or fronts a street. Generally the business frontaqe contains the pdmary entrance of the buildinq. August 11, 2004 7 F. G. H. J. K. Can or cabinet sign. A sign that contains all of the text and/or Io(~o symbols within a sinqle enclosed cabinet and may or may not be illuminated. These are prohibited signs within the overlay zoning district. Commercial message: A message placed or caused to be placed before the public by a person or business enterprise directly involved in the manufacture or sale of the products, proDerb/, accommodations, services, attractions, or activities or possible substitutes for those thin(~s that are the subiect of the messaGe and that: Refers to the offer for sale or existence for sale of products, property, accommodations, services, attractions, or activities that are offered or exist for sale or for hire on the subject premises; Attracts attention to the off-premises public to a business or to products, property, accommodations, services, attractions, or activities that are offered or exist for sale or for hire on the subject premises. These are requlated regardless of whether behind qlass or not. Double-faced sign: A sinqle siqn with two parallel sign faces back to back. Driveway: Every entrance or exit used by vehicular traffic to or from properties abutting a roadway. Driveway, HiGh Volume: A driveway used or expected to be used by more than 1500 vehicles per day. Driveway, Low Volume: A driveway used or expected to be used bv more than 25 but less than 750 vehicles per day. Driveway, Medium Volume: A driveway used or expected to be used bv more than 750 but (ess than 1500 vehicles per day. Fence: Any enclosing barder, constructed of wood, metal or any other material, reqardless of its use or purpose. Grand openinq: A qrand ooeninq refers to the beqinnin.~ of a new business in a new location of or the assumption of ownership of an existinq business by a new owner or qroup of owners. Multi-faced sign: A sin~lle sign with two or more faces which are not parallel nor back to back, Augus[11,2004 8 Nameplate: Anv siqn which denotes only the individual, firm, business, or corporate name of the occupant of the premises. Noncommercial messa(ie: A messa(ie that is not a commercial message. Outparcel or out-tract development: A tract or reserve platted as part of the development of a shoppin¢~ center or inte(irated business development {IBD) that is independent of the IBD. Parkincl, landscapin(i and si.qna(ie for such out-parcel or out-tract are determined separately from the adiacent shol~pin(i center or IBD. Principal buildinq: The buildinq or buildinqs on a lot that are occupied by a primarv use. Chan(ieable copy siqn: Any siqn that allows the copy to chanqe. For the purposes of this ordinance, no siqns that are not permanentlv affixed to the qround may be considered elic~ible for consideration as chancleable copy si(ins. These si(ins may be liqhted or unli(ihted, with detachable precut letters and fi(lures, or the messaqe may be electronic. Riqht-of-way: A strip of land either dedicated or owned bv the city or other public aqenc~, and used for the purpose of a public way or roadway. Roofline: The heiciht above finished (irade of the upper beam, rafter, rid(~e or purlin of any buildinq. Pudin is a horizontal timber or beam that supports the rafters of the roof such as the deck of the roof. Roof siqn. Any siqn constructed, erected, or placed above the eave of a sloped roof, deckin(i or of a fiat roof. Screeninq: Hedcles, informal plantin(Is, natural ve(ietative covers, berms, or manmade fences or walls provided for the purpose of Drotectin~ adjacent uses from potential noise, qlare, trash, odor, visual disorder, or other harmful, intrusive or noxious effects. Setback: The distance between a wall or any projection of a buildin(i and the property line excludin(i steps and unenclosed porches. Si(in - Informational: Informational si(ins erected on-site by public and private developments directin(i or denotin(i the entrance, exit, parkinq, and direction of traffic flow. August 11, 2004 9 1. The directional sicms may not exceed two square feet in area per sign. 2. No Ioqos, emblems or other identifyJncl symbols of the development may be placed on directional siclns. Sicln facincl or surface: The surface of any sicln upon, aclainst or throuclh which the messacle is displayed or illustrated; provided, however, for siqns in which the words, letters or symbols are independently mounted, the sicln surface area must be that of the smallest regular cleometric form that will whollv contain all of the elements. Y. Street fronta~le: The lenclth of a lot or tract of land which is adiacent to a public or pdvate street. Structure: Anythinq constructed or erected, which recluires location on the qround, or attached to somethincl havinq a location on the ground. AA. Subdivision: The division of any lot, tract or parcel of land by plat, map or description into two or more parts for the purpose of sale, rental, lease or division of ownership. Section 13A.llArchitectural Overlay Zone Re(3uirements 13A-11.01. Purpose. A. The purpose of the requlations described in this section is to create a better island by utilizincl a theme and style of architecture that celebrates the coastal and Spanish hedta.qe of South Texas and promotes cluality building desiqn for multi-family and nonresidential structures on the main thorouclhfares of Padre Island. The areas covered by these rec~ulations are depicted on the attached map. These areas are .qenerallv properties aloncl Park Road 22 and S.H. 361 and extendincl to the Gulf Beach. The reclulations are intended to influence and reflect Spanish, Mediterranean, or Coastal-style architectural design, appropriate to this reclion's climate, durincl the construction and reconstruction of buildinqs on Padre Island, to achieve a "resort" feelJncl and visually desirable environment and to protect and enhance the value of private property. 2. Commercial areas should be attractive to visitors as well as to residents of Padre Island. Augus{l~,2004 10 Quality construction promotes economic qrowth and preserves properti values to the benefit of both commercial and residential property owners. In order to accomplish these purposes, standards are provided that will quide the desiqn of all multifamiN and commercial buildinqs in the Island Overlay Zoninq District. 13A-11.02. Applicability. The rules contained in this section are applicable to all properties rezoned to the Island Overlay District. The requlations contained in the AOZ #1 are in addition to the district requlations of the underl¥inq district. 13A-11.03. General Standards, Treatments and Materials. A. Buildinq Desiqn 1. All architectural buildinQ stiles shall be described and controlled by the followinq six desi.~n characteristics. General Massinq - Predominate shape of the structure with recjard to the specific buildinq style. Shopping centers and other lame buildinqs must be desianed to reduce their apparent bulk bv dividin¢~ the buildinq mass into several smaller-scaled components, includinq the use of Iow-scale planters, site walls, variations in roof forms and heiqht, and the Iowerina of parapets when not needed to screen mechanical equipment. Exterior Wall Materials & Finishes - which can be viewed from public ri~ht-of-wav - Shall be consistent with the specific buildinq stile. Hi,~h qualiti synthetic materials which simulate the oriqinal material of a particular buildinq stile will be considered. Walls shall be constructed of one or a combination of the followinq materials with no 4'x 8' sheets of sidinq allowed: 1. Stucco 2. Masons, Brick, or Stone 3. Cementious Sidinq 4. Wood 5. Vinyl sidinq. Vinyl sidinq may not be used for new construction on properties with frontaqe on Park Road 22 or properties located in the Lake Padre Area as indicated on Attachment C - Vinyl Boundary Map. In addition, existinq 2004 11 August11,2004 development oriclinallv constructed with vinyl sidinq wall material may replace vinyl within the areas desiclnate vinyl "not allowed" on Attachment C. Where vinyl is allowed for new construction or as a new wall coverincl to replacement existinq vinyl sidinq, the followinq specifications shall be met: · Nominal 0.42" mill thickness · 5/8" profile heiqht · Reinforced nail hem · Desiclned for 160 MPH wind-load when attached on 16" centers. Storefront qlass is to be limited to 15% of a buildin~l facade and must be consistent with the chosen desiqn theme, Roof Form and Materials - The shape of the roof, the heiclht of its pitch shall be specific to the buildinq style. Roof materials for pitched roofs shall be consistent with buildinq style and limited to the followinq: 1. Metal - Standin.q Seam, 5-V crimp, or corruciated. Unpainted Galvalume finish is preferred. 2. Tile - Slate, Terra cotta, clav, or concrete tile. Shinclles - Architectural dimensional composition shinqle (the use of 3-tab shinqles is prohibited), or metal. 4. Roof screeninq - all roof top ecluipment shall be screened from view when viewed from the clround. Openinqs, which can be viewed from public riclht-of-way. The shape of an openincl, its proportion relative to buildin.q massinq, how it functions, how it is divided, and the rhythm of openin(~s within a structure must be specific to the buildinq style. Additive Elements - Dormers, cupolas, chimnevs, balconies, porches, bays, colonnades, brackets, stoops and any other desicln elements, - which can be viewed from public dqht-of-wa¥, shall be specific to the buildincl style. 12 Color and Brightness - all exterior walls and accents, which can be viewed from public riqht-of-wav, shall compliment buildinq style and must conform to the attached color palette ('Appendix B) - deviations shall be submitted for review and approval bv the City. Exterior paint must be fiat or non-qlossv. B. Liqhtinq 1. Outdoor liqhtinq is allowed at the followinq levels as measured at the property line of the less restrictive zoninq desiqnation: · 0.2 foot-candles for all sinqle family zoninq desiqnations · 1 foot-candle for all multifamily zoninq desiqnations · 3 foot-candles at all non-residential zoninq desiqnations 2. Outdoor liqhtin.q may not be used as an attention-~:lettinq device or as additional siqnaqe for a buildin~l. 3. Li(~ht fixtures must be shielded to prevent qlare on adjacent @roper~ies. 4. The City may require a photometric plan. 5. Direct liqhtinq that is used to illuminate sic~naqe must be shielded to prevent glare on drivers. 13A-11.04 - Architectural Styles A. Listed below are architectural buildin~l styles which reflect Spanish, Mediterranean, or Coastal-style architectural desiqn appropriate for Padre Island. A complete description, alon.q with illustrations are depicted in A FIELD GUIDE TO AMERICAN HOUSES (published by Alfred A. Knopf, Inc., New York, copvriqht 1984), written by Virqinia & Lee McAlester. 1. Develol)ment Review Process for Padre Island Architectural Overlav Desi~lnafion 13A-12.01 (al Site plan review is required for anv multifamilv proiect containinq five or more units, all townhouse developments, ail commercial and industrial projects, and renovations resultin.q in a chan~e of use or buildinq footprint. 13A-12.02 (b) All plans shall be siqned and sealed by the appropriate desiqn professional 13A-12.03. Owners of proiects that are whollv or substantiallv inconsistent with the regulations contained in this article mav seek approval of a Planned Unit Development ('PUD) from the Citi of Corpus Christi. In such cases, City Staff shall review any PUD applications of this article and provide a recommendation on the proiect to the Plannincl Commission and City Council. Amonq other issues, the recommendation of the City Staff concerning a PUD application must address the compatibility of the prol3osed use, architectural stile, landscapinq, parking, and siqnaqe proposed in the PUD, with the development standards contained this article. Augus[11,2004 14 13A-12.04. Architectural Review Application Process. Pre-submittal procedures. Prior to the preparation and submission of buildinq plans, an applicant for a buildinq permit shall submit a development plan review application and contact the-Development Services Department to schedule a pre-submittal meetinq with City staff to discuss the architectural and site requirements contained in this article. 1. The applicant must provide elevations, perspectives, and a site plan for the proiect one week prior to the pre-submittal meetinq. After the pre-submittal meetin~l and before buildinq plans are prepared, the applicant shall prepare a scaled site plan, perspectives showJnq two sides and elevations of all structures on the site for submission and review by Staff. The site plan must show the location of all features includin(~ proposed parkin(~, landscapin¢~, and siqna(le, as well as the elevations of accessory structures and dumpster and mechanical enclosures. b. The information supplied by applicant must include all materials, colors, and treatments that are proposed for use on the project. B. Application processin¢~ procedures. 1.
