HomeMy WebLinkAbout025912 ORD - 08/24/2004AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON NOVEMBER 2, 2004, IN THE CITY OF CORPUS CHRISTI ON THE QUESTIONS OF AUTHORIZING OBLIGATIONS OF THE CITY SUPPORTED BY AD VALOREM TAXES; PROVIDING FOR PROCEDURES FOR HOLDING SUCH ELECTION; PROVIDING FOR NOTICE OF ELECTION AND PUBLICATION THEREOF; PROVIDING FOR ESTABLISHMENT OF BRANCH EARLY POLLING PLACES; DESIGNATING POLLING PLACE LOCATIONS; AUTHORIZING A JOINT ELECTION WITH NUECES COUNTY; AND ENACTING PROVISIONS INCIDENT AND RELATING TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE AND DECLARING THAT THIS ORDINANCE SHALL BE EFFECTIVE IMMEDIATELY UPON 1TS ADOPTION BY CITY COUNCIL, IN ACCORDANCE WITH PROVISIONS OF V.T.C.A., GOVERNMENT CODE, SECTION 1201.028. WHEREAS, the City Council finds that the citizens of Corpus Christi should have the opportunity to approve the issuance of obligations of the City supported by ad valorem taxes for needed public improvements; and WHEREAS, the City is authorized by Article VIII of the City Charter to issue general obligation bonds in accordance with State law; and WHEREAS, it is provided in Section 3.004 of the Texas Election Code that the governing body shall order elections pertaining to municipal affairs, give notice and appoint election officers to hold the election; and WHEREAS, Nueces County will also be conducting a general election on November 2, 2004. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. A Special City election (hereinafter the "Election") shall be held in the City of Corpus Christi, Texas, on November 2, 2004, for the purpose of submitting to the voters of the Ctty ballot propositions that authorize the issuance of obligations supported by ad valorem taxes. SECTION 2. At the Election all the qualified voters of the City of Corpus Christi shall be permitted to vote. SECTION 3. Precinct ballot counters shall be employed at the election in accordance with the Texas Election Code and the Election shall be held at the polling places in the regularly prescribed precincts of the City of Corpus Christi, as set forth on Attachment A hereto Election 2004 bon~s 7 & 8 incorporated by reference and made part of this ordinance. The Election shall be held in accordance with the election laws of the State of Texas. The polls shall be open fi.om 7:00 a.m. to 7:00 p.m. on the day of the Election. Testing of the precinct ballot counting equipment shall be conducted as prescribed by the Secretary of State's directive "Alternate Method of Testing Precinct Ballot Equipment". SECTION 4. The City Secretary shall conduct the Election as directed by ordinance of the City Council and by law in accordance with the joint election agreement to be entered into with Nueces County. He is directed to request consideration by the U. S. Department of Justice of the sub~mssion of any change herein which requires preclearance, and to provide such demographic data and information as required by law SECTION 5. Paper ballots and precinct ballot counters shall be used for the conduct of the Election on election day and for early voting. Early voting in person at each of the temporary branch polling places shall be conducted as follows: Such early voting in person may be conducted at the main early voting polling place located in the first floor lobby of Nueces County Courthouse, 90I Leopard, or at the temporary brmlch polling places set forth in Attachment B, incorporated by reference and made a part of this ordinance. In addition, early voting in person may be conducted at the mobile temporary branch polling places set forth in Attachment C, incorporated by reference and made a part of this ordinance, during the days and hours specified therein. The City Secretary is authorized, in the event of an emergency, preventing any of the designated polling places from being utilized, to provide for suitable replacement locations. Each branch polling place and the main early polling place shall serve all election precincts. SECTION 6. The City Secretary is directed to post and publish such election notices as are required by the Election Laws of the State of Texas. The City Secretary is further appointed as the authority and officer responsible for the conduct of said election and is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this State including but not limited to coordinating the election process, including use of tabulation equipment, supplies and printing of ballots, in accordance with the joint election agreement to be executed with Nueces County. SECTION 7. At the Election, the voters shall be presented with the following propositions (in English and Spanish) in the fom~ prescribed by the Texas Election Code: Election 2064 b~*nds 7 &8 PROPOSITION NO. 1 STREETS FOR AGAINST Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue, in accordance with law at the time of issuance, the public securities of the City, in one or more series or issues, in the aggregate principal amount of $68,350,000.00 with the public securities of each such series or issues, respectively, to mature serially or otherwise within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates, as shall be determined w~thin the discretion of the City Council, for the construction of pcmmnent street improvements throughout the City, including, without limitation, constructing, reconstructing, restructuring and extending the streets, thoroughfares, sidewalks, streetscapes, collectors, and storm drains in said City; INCLUDING: *ADA IMPROVEMENTS, *CIMARRON BLVD., PH. 1 SARATOGA TO YORKTOWN, *CIMARRON BLVD., PH. 2 YORKTOWN TO BISON (MIRELES), *DODDRIDGE STREET OCEAN DR1VE TO STAPLES, *EVERHART ROAD, PH. 1 SARATOGA TO CEDAR PASS, *NORTH PORT AVE IH 37 TO US 181, *UP RIVER ROAD RAND MORGAN TO MCKENZIE, *WALDRON ROAD - PURDUE TO GLEN OAK & MEDITERRANEAN EXT, *FUTURE TXDOT PARTICIPATION, *NEIGHBORHOOD STREET RECONSTRUCTION, INCLUDING: -RIVERSIDE AREA (BEHIND CALALLEN HS AREA), -NUECES BAY/BUDDY LAWRENCE AREA, -SOUTH PORT/GREENWOOD AREA, -MANSHEIM/SUNNYBROOK AREA, -HOLLY/KOSTORYZ AREA, -ALAMEDA/REID AREA, -NILE AREA; *STREET LIGHTING, *STREET OVERLAYS, INCLUDING: -WILLIAMS DRIVE, -MCARDLE ROAD, -GOLLIHAR ROAD, -WHITECAP BOULEVARD, -BALDWIN BOULEVARD, -AYERS STREET, -CALALLEN DRIVE, -WEST REDBIRD LANE, *TRAFFIC CONGESTION MANAGEMENT, *TRAFFIC SIGNALS (NEW & UPGRADES), *CLIFF MAUS, PH. 2 BROWNSVILLE RD TO BEAR LANE, Election 2004 Nmds 7 & 8 *CLIFF MAUS, PH. 3 - SPID TO ROCKFORD DRiVE, *WOOLDRIDGE ROAD - AIRLINE ROAD TO RODD FIELD, *WOOLDRIDGE ROAD STAPLES STREET TO AIRLINE ROAD, *DEVELOPER PARTICIPATION, *GREENWOOD DR. PROPOSITION NO. 2 PUBLIC HEALTH & SAFETY FOR AGAINST Shall the City Council of the Ctty of Corpus Christi, Texas, be authorized to issue, in accordance with law at the time of issuance, the public securities of the City, tn one or more series or issues, in the aggregate principal amount of $1,900,000.00 with the public securities of each such series or issues, respectively, to mature serially or otherwise within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates, as shall be determined within the discretion of the City Council, for the construction of permanent public safety improvements to fire stations tkroughout the City and the acquisition of necessary sites therefor; INCLUDING: *SOUTHSIDE FIRE STATION, *ADA CO-ED FIRE STATIONS, *AND OTHER PUBLIC HEALTH AND SAFETY IMPROVEMENTS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes on all taxable property in the City in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay the public securities at maturity? FOR AGAINST PROPOSITION NO. 3 PUBLIC FACILITIES Election 2(X~4 bonds 7 & S Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue, in accordance with law at the time of issuance, the public securities of the City, in one or more series or issues, in the aggregate principal amount of $5,660,000.0~ with the public securities of each such series or issues, respectively, to mature serially or otherwise within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates, as shall be detemfined within the discretion of the City Council, for the acquisition of land and the construction of permanent improvements, including, without limitation, new library and learning center construction and expansion of existing libraries; INCLUDING: *NW LIBRARY EXPANSION, *MUSEUM FIRE SUPPRESSION, PH. 2, *NEW SOUTHSIDE LIBRARY, *AND OTHER PUBLIC FACILITY IMPROVEMENTS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes on all taxable property in the City in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay the public securities at maturityo PROPOSITION NO. 4 PARK & RECREATION FOR AGAINST Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue, in accordance with law at the time of issuance, the public securities of the City, in one or more series or issues, in the aggregate pnncipal amount of $7,406,000.00 with the public securities of each such series or Issues, respectively, to mature serially or otherwise within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates, as shall be determined within the discretion of the City Council, for the acquisition and construction of park and recreation facilities throughout the City; INCLUDING: *SPORTS FIELD IMPROVEMENTS, *GOLF COURSE IMPROVEMENTS (EXISTING COURSES), *RENOVATE SENIOR & RECREATION FACILITIES, *HEB TENNIS CENTER, *NEIGHBORHOOD PARKS IMPROVEMENTS, *WINDSPORT PARK IMPROVEMENTS, AND OTHER PARK AND RECREATION IMPROVEMENTS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes on all taxable property in the City in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay the public securities at maturity? Election 2(194 bonds 7 & 8 PROPOSITION NO. 5 BAYFRONT MASTER PLAN PROJECT FOR AGAINST Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue, in accordance with law at the time of issuance, the public securities of the City, in one or more series or issues, in the aggregate principal amount of $11,684,000.00 with the public securities of each such series or issues, respectively, to mature serially or otherwise within not to exceed forty years from their date, and to be sold at such prices and bear interest at such rates, as shall be determined within the discretion of the City Council, for the acquisition of land and the construction ofpe'rmanent public improvements for the Bayfront Development Plan, including, without limitation, constructing, reconstructing, restructuring and extending the streets, thoroughfares, sidewalks, streetscapes, collectors, and storm drains along Shoreline Drive, developing parks and recreational facilities along Shoreline Drive, and related public improvements; INCLUDING: *BAYFRONT DEVELOPMENT PLAN PHASE 1, *AND OTHER BAYFRONT IMPROVEMENTS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes on all taxable property in the City in an amount sufficient to pay the annual interest on said public securities and provide a sinking fund to pay the public securities at maturity? SECTION 8. Election 2004 bonds SECTION 9. The voter-approved obligations issued pursuant to Propositions 1, 2, 3, 4 and 5 referenced above shall be secured by the full tax rate authorized by the Texas Constitution, in accordance with Article VIII, Section l(b) of the City Charter. SECTION 10. The election shall be conducted in accordance with the agreement between Nueces County and the City of Corpus Christi to hold a joint election on November 2, 2004, which shall be executed and attached hereto as Attachment D and incorporated herein. The City Secretary is authorized to approve all lawful changes and additions to the procedures provided herein in order to implement such agreement, including but not limited to prowsions /bt substations and mobile voting sites. SECTION 11. By approving and signing this ordinance, the Mayor officially confirms and orders as his actions all matters recited in this ordinance which by law come within his jurisdiction. SECTION 12. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance or the ballot herein shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, work, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 13. In accordance with the provisions of V.T.C.A., Government Code, Section 1201.028, this Ordinance shall be effective immediately upon its adoption by the City Council.
