HomeMy WebLinkAbout025974 ORD - 09/28/2004Page 1 of 2 AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A PARTICIPATION AGREEMENT WITH MPM DEVELOPMENT, L.L.C., OWNER AND DEVELOPER OF ROYAL CREEK ESTATES UNIT 1 SUBDIVISION, FOR PUBLIC STREET IMPROVEMENTS ON EXCALIBUR ROAD, AN URBAN ROADWAY ABUI-FING A DEDICATED PUBLIC PARK, IN ACCORDANCE WITH THE PLAi liNG ORDINANCE, NOT TO EXCEED $29,949.00 FOR THE CITY'S SHARE OF COSTS OF THE IMPROVEMENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS: SECTION 1. That the required funds having been appropriated, the City Manager, or his designee, is authorized to execute a participation agreement with MPM Development, EEC., Developer, for the construction of public street improvements on Excalibur Road, an urban roadway abutting a dedicated public park, in accordance with the platting ordinance, not to exceed $29,949.00 for the City's share of the costs of the improvements. A copy of the agreement is on file with the City Secretary's office. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 28th of September, 2004. For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings. I/~ve, therefore, request that you suspend said Charter rule and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
