AN ORDINANCE
ABANDONING AND VACATING A 3,379.70-SQUARE FOOT PORTION
OF A 7.5-FOOT WIDE UTILITY EASEMENT IN LOT 1, BLOCK 2,
KING'S CROSSING UNIT 13; REQUIRING THE OWNER, WINDSOR
PARK CHURCH OF CHRIST, TO COMPLY WITH THE SPECIFIED
CONDITIONS; AND DECLARING AN EMERGENCY.
WHEREAS, there is a 3,379,70-square foot portion of a 7.5-foot wide utility easement in
Lot 1, Block 2, King's Crossing Unit 13, as recorded in Volume, Page, Map Records
Nueces County, Texas, that the owner, Windsor Park Church of Christ, (Owner), wishes
to have abandoned and vacated; and
WHEREAS, it has been determined that it is feasible and advantageous to the City of
Corpus Christi to abandon and vacate said portion of the utility easement for all
purposes, subject to the provisions below.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS, THAT:
SECTION 1. That the 3,379.70-square foot portion of a 7,5-foot wide utility easement in
Lot 1, Block 2, King's Crossing Unit 13, as recorded in Volume, Page, Map Records
Nueces County, Texas is abandoned and vacated for public use as utility easement,
subject to Owner's compliance with the following specified conditions as part of the
abandonment and vacation:
1. Fair market value will be waived because Owner will be dedicating a utility
easement of greater value to off-set the proposed abandonment and vacation of
the easement.
2. Upon approval from Council and ordinance issued, all grants of easement
closures must be recorded at Owner's expense in the real property records of
Nueces County, Texas, Prior to Building Permit approval of construction, an up-
to-date survey, abstracted for all easements and items of record, must be
submitted to the Director of Development Services.
3. Owner must comply with all the specified conditions of the ordinance within 180
days of Council approval; however, the Director of Development Services may
extend the time limit for an additional 180 days if extenuating circumstances
outside the Owner's control necessitate an extension,
SECTION 2. That upon written request of the Mayor or five council members, copy
attached, the City Council (1) finds and declares an emergency due to the need for
immediate action necessary for the efficient and effective administration of City affairs
and (2) suspends the Charter rule that requires consideration of and voting upon

ordinances at two regular meetings so that this ordinance is passed and takes effect
upon first reading as an emergency measure this the 25th day of January, 2005.

emergency exists requiring suspension of the Charter rule as to consideration and
voting upon ordinances at two regular meetings: INVe, therefore, request that you
suspend said Charter rule and pass this ordinance finally on the date it is introduced, or
at the present meeting of the City Council.

FIELDNOTES for the closure of a 7.50 foot wide utility easement out of Lot 1, Block 2, King's Crossing
Unit 13, a map of which is recorded in Volume 60, Page 164, Map Records of Nueces County, Texas; said
easement being more fully described by metes and bounds as follows:
BEGINNING at a point on the southeast boundary of said Lot 1, Block 2, from which point the northeast
corner of said Lot 1, Block 2, same being the southwest boundary of said Yorktown Boulevard, a 120 foot
wide public roadway,bears North 29°00'34"East,a distance of 10.00 feet;
THENCE, South 29°00'34" West, along the southeast boundary of said Lot 1, Block 2, a distance of 400.62
feet for an interior corner of said Lot 1, Block 2 and of this easement;
THENCE, South 61°01'12" East, along the lower northeast corner of said Lot 1, Block 2,a distance of
42.50 feet for a corner of this easement;
THENCE, South 28°58'48" West, a distance of 7.50 fora corner of this easement;
THENCE,North 61°01'12" West, parallel to the lower northeast boundary of said Lot 1, Block 2, and 7.50
feet distant therefrom measured at right angles thereto, a distance of 50.00 feet for a corner of this
easement;
THENCE,North 29°00'34" East, parallel to the southeast boundary of said Lot 1, Block 2,and 7.50 feet
distant therefrom measured at right angles thereto, a distance of 408.13 feet for a corner of this easement;
THENCE, South 60°57'10" East,parallel to the southwest boundary of the above mentioned Yorktown
