HomeMy WebLinkAbout026363 ORD - 07/26/2005 Page 1 of 2 AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A PARTICIPATION AGREEMENT WITH ALTY ENTERPRISES, INC., DEVELOPER OF GREYSTONE SUBDIVISION- UNIT 1, FOR THE CONSTRUCTION OF THE ONE-HALF STREET (SYDNEY STREET), LOCATED APPROXIMATELY 1,300 L.F. SOUTH OF SLOUGH ROAD, EAST OF ROOD FIELD ROAD AND NORTH OF MASTER DITCH 31; IN ACCORDANCE WITH THE PLATTING ORDINANCE, OF WHICH THE CITY'S SHARE OF COST SHALL NOT EXCEED $88,443.79; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS: SECTION 1. That the required funds having been appropriated, the City Manager, or his designee, is authorized to execute a participation agreement with Alty Enterprises, Inc. Developer, for the construction of one half street (Sydney Street), located approximately 1,300 L.F. south of Lipes Boulevard, east of Rodd Field Road and north of Master Ditch 31, in accordance with the platting ordinance, of which the City's share of costs shall not exceed $88,44379 A copy of the agreement is on file with the City Secretary's office SECTION 2. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 26th of July, 2005. For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings.
