ORDINANCE
AMENDING ORDINANCE NUMBER 23804 WHICH ESTABLISHED A
MUNICIPAL COURT TECHNOLOGY FUND, BY REPEALING
SECTION 4 TO ELIMINATE AN EXPIRATION DATE OF SEPTEMBER
1, 2005; PROVIDING FOR SEVERANCE; PROVIDING FOR
PUBLICATION; PROVIDING AN EFFECTIVE DATE AND DECLARING
AN EMERGENCY.
WHEREAS, in 1999, the Texas Legislature enacted Article 102.0172 of the Code of
( riminal Procedure which provides for the establishment of a Municipal Court Technology Fund
lw ordinance; and
WHEREAS, the initial legislation contained a provision that the Municipal Court
Technology Fund expires September 1, 2005; and
WHEREAS, on October 19, 1999, City Council authorized Ordinance Number 23804
which established a four dollar Municipal Court technology fee; and
WHEREAS, Section 4 of Ordinance Number 23804 provided for expiration of
ordinance on September 1. 2005; and
WHEREAS, in 2003, the Texas Legislature repealed Article 1 02.0172(f), which resulted
In the elimination of an expiration date for this provision;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance Number 23804 be amended by repealing Section 4 to
climlOate an expiration date of September 1, 2005.
SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word
,l[ provision of this ordinance shall be held invalid or unconstitutional by final judgment of a
coun of competent jurisdiction, it shall not affect any other section, paragraph, subdivision,
clause, phrase, word or provision of this resolution. It is the definite intent of this City Council
that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full
((,rce and effect for its purpose.
SECTION 3. Publication shall be made in the official publication of the City of Corpus
Christi as required by the City Charter ofthe City of Corpus Christi.
SECTION 4. That upon written request of the Mayor or five Council members, copy
attached, the City Council (l) finds and declares an emergency due to the need for immediate
action necessary for the efficient and effective administration of City affairs and (2) suspends the

emergency exists requiring suspension of the Charter rule as to consideration and

at the present meeting of the City Council.
