HomeMy WebLinkAbout026455 ORD - 09/13/2005 AN ORDINANCE AMENDING THE CODE OF ORDINANCES CHAPTER 53 TRAFFIC, BY REVISING SECTION 53-114, SPEED LIMIT WHEN ROAD OR ABUTTING PROPERTY UNDER CONSTRUCTION OR REPAIR; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; PROVIDING FOR PENALTIES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The code of ordinances of the City of Corpus Christi is amended by revising Section 53-114, Speed limit when road or abutting property under construction or repair, to read as follows: CHAPTER 53. TRAFFIC * * * Article V. Operation of Vehicles * * * Sec. 53-114. Speed limit when road or abutting property under construction or repair. @lIt IS hereby determined upon the basis of an engineering and traffic investigation that the maximum reasonable and prudent speed limit on any street, road, highway, bridge or causeway within the city upon which construction, reconstruction or repair is in progress or any construction on private property abutting any street, road or highway of the city in connection with which construction work a portion of the street, road or highway is being barricaded or used shall be as follows: (1) Where the regular la'Nful m3ximum speed is above thirty (30) miles per hour, the The maximum speed may be reduced in increments of five (5) miles per hour down to thirty (30) miles per hour. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi as required by City Charter of the City of Corpus Christi. SECTION 4. Penalties are as provided in this Chapter" SECTION 5. That upon written request of the Mayor or five council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure this the 13th day of September, 2005. f...... f: ".
