AN ORDINANCE
AMENDING THE CODE OF ORDINANCES CHAPTER 53-
TRAFFIC, SECTION 53-84, PROJECT ELIGIBILITY
REQUIREMENTS AND DESIGN STANDARDS, BY
INCORPORATING THE URBAN TRANSPORTATION PLAN
WHICH IS TO BE USED FOR THE IDENTIFICATION OF
STREETS IN DETERMINING ELIGIBILITY FOR TRAFFIC
CALMING DEVICES; PROVIDING FOR SEVERANCE;
PROVIDING FOR PUBLICATION; AND DECLARING AN
EMERGENCY.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI:
SECTION 1. That the Code of Ordinances, City of Corpus Christi is amended by
amending Chapter 53-Traffic, Section 53-84, Project eligibility requirements and
design standards, by incorporating the Urban Transportation Plan which is to be
used for the identification of streets in determining eligibility for traffic calming
devices"

Sec. 53-84. Project eligibility requirements and design standards.

(1) Operational and geometric requirements of the street-
Consideration of physical devices"
a Only functionally-classified "residential" and "neighborhood
collector" streets having not more than one (1) travel lane in
each direction and not more than forty (40) feet in width
(measured from back-of-curb to back-of-curb) shall be
considered for installation of traffic calming devices" Any
functionally-classified "through street" identified in the city's

Code of Ordinances section 53-251, or public street riQht-of-way
identified as a collector, parkway, arterial, rural arterial, or
freeway/expressway on the currently adopted City of Corpus
Christi Urban Transportation Plan, or other street which has
function to substantially serve through traffic immediately
abutting residential subdivisions shall not qualify.

SECTION 2. If for any reason any section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it shall not
affect any other section, paragraph, subdivision, clause, phrase, word or
provision of this ordinance, for it is the definite intent of this City Council that
every section, paragraph, subdivision, clause, phrase, word or provision hereof
be given full force and effect for its purpose"
SECTION 3. Publication shall be made one time in the official publication of the
City of Corpus Christi as required by City Charter of the City of Corpus Christi.
SECTION 4. That upon written request of the Mayor or five council members,
copy attached, the City Council (1) finds and declares an emergency due to the
need for immediate action necessary for the efficient and effective administration
of City affairs and (2) suspends the Charter rule that requires consideration of
and voting upon ordinances at two regular meetings so that this ordinance is
passed and takes effect upon first reading as an emergency measure this the
13th day of September, 2005

For the reasons set forth in the emergency clause of the foregoing ordinance, an
emergency exists requiring suspension of the Charter rule as to consideration
and voting upon ordinances at two regular meetings: IM/e, therefore, request that
you suspend said Charter rule and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
