HomeMy WebLinkAbout026461 ORD - 09/13/2005 ORDINANCE AN ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, AMENDING CHAPTER 57 "VEHICLES FOR HIRE," ARTICLE II "TAXICABS" BY AMENDING SECTION 57-32(5) "SAME- INFORMATION TO BE GIVEN," SECTION 57-36 "TAXICAB STREET USE FEE," OF THE CORPUS CHRISTI CODE OF ORDINANCES, TO ESTABLISH THE MINIMUM NUMBER OF VEHICLES PLACED INTO SERVICE AT THE TIME OF ISSUANCE OF A TAXICAB CERTIFICATE; AND AMENDING CHAPTER 57 "VEHICLES FOR HIRE," ARTICLE II, "TAXICABS," BY AMENDING SECTION 57-56 "LIABILITY INSURANCE" TO PROVIDE THAT THE DIRECTOR OF SAFETY AND RISK MANAGEMENT SHALL HAVE THE AUTHORITY TO ADJUST LIABILITY INURANCE COVERAGE LIMITS IN ACCORDANCE WITH SECTION 17-19 OF THIS CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Corpus Christi Code of Ordinances, Chapter 57 "Vehicles for Hire," Section 57-32(5) "Same-Information to be given," is hereby amended as follows: Sec. 57-32. Same--Information to be given" Every application for a certificate under this article shall include the following information: (5) The minimum and maximum number of vehicles proposed to be operated by the applicant. The minimum number of vehicles placed into service at the time of issuance of a certificate shall be at least one. SECTION 2. That the Corpus Christi Code of Ordinances, Chapter 57 "Vehicles for Hire" Section 57-36 "Taxicab street use fee," is hereby amended as follows: Sec 57-36. Taxicab street use fee. r a) Each owner holding a certificate to operate a taxicab upon the streets within the city shall pay the city each three (3) month period as a taxicab street use fee an amount equal to one hundred dollars ($100.00) times the maximum number of vehicles authorized by a current and valid certificate. For the purpose of calculatina the taxicab street use fee, +!he maximum number of vehicles shall be no lower than five (5). (b) Notwithstanding the provisions of section 57-35 a certificate holder may, upon written request to the city manager or his designee, apply to increase or decrease \^. CAB.i'., I) ~~ h 4 6 1 prospectively the maximum number of vehicles authorized to be operated during the following consecutive twelve (12) month period of the remaining term of the current certificate \ C ) The number of vehicles in service by a certificate holder shall not exceed the maximum number of vehicles authorized to be operated under such certificate. (d) The annual street use fee shall be paid in four (4) payments as follows: on or after January 1 and before January 10; on or after April 1 and before April 10; on or after July 1 and before July 10; on or after October 1 and before October 10. (e) If the holder of the certificate shall fail to comply with any requirement herein or shall willfully file any false statements, the same shall be cause for a suspension or revocation of the certificate authorizing the holder to operate a taxicab service within the city Section 2" That the Corpus Christi Code of Ordinances, Chapter 57 "Vehicles for Hire," Section 57-56 "Liability Insurance-Generally" is hereby amended to read as follows: Sec 57-56. Liability Insurance--Generally. Before any license or permit shall be issued to any owner or operator of a taxicab or before any renewal of a license or permit shall be granted, the owner or operator shall be required to file a certificate of insurance with the taxicab inspector and thereafter keep in full force and effect a policy of public liability insurance with a company duly authorized to do business in the state and performable in the county, insuring the public against any loss or damage that may result to any person or property from the operation of such vehicle; prOVided, that the maximum amount of recovery in such policy of insurance specified shall not, for each vehicle, be less than fifty thousand dollars ($50,000.00) for injury or death of one person and one hundred thousand dollars ($100.000.00) for injuries or deaths in anyone occurrence; and not less than twenty-five thousand dollars ($25,000.00) for injury to or destruction of property in anyone occurrence; Each insurance policy shall require notice from the insurer to the city at least ten (10) days before any such policy is to be terminated for any reason by the insurer or by the insured" So as to adequatelv protect the City of Corpus Christi and its residents, the director of safety and risk manaqement shall have the authority to adiust liabilitv insurance coveraqe limits 1D accordance with Section 17-19 of this Code of Ordinances. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is \X CARb passes and takes effect upon first reading as an emergency measure on this the L"!: - day of September, 2005, ATTEST: /~- /; f-/i i ,.
