HomeMy WebLinkAbout026530 ORD - 10/25/2005 ORDINANCE REPEALING ORDINANCE NO. 5347, ADOPTED ON MAY 6, 1959, AND ORDINANCE NO. 5442, ADOPTED ON JULY 29, 1959, AMENDING THE RESTRICTIONS RELATING TO BLOCK "A' PARKDALE SHOPPING CENTER; AND DECLARING AN EMERGENCY WHEREAS, the City of Corpus Christi formerly provided for written agreement with a property owner to amend restrictions set forth in subdivisions plats and recorded such agreements in the Real Property Records of Nueces County; WHEREAS, the City of Corpus Christi no longer requires such agreements and provides for changes to subdivision restrictions by means of a replat of the affected property; WHEREAS, such an agreement filed in the Real Property Records of Nueces County clouds the title of Block "A". Parkdale Shopping Center; WHEREAS, Block "AU of Parkdale Shopping Center was replatted as Block AR. Parkdale Shopping Center by approval of the City's Planning Commission on March 30. 1976. and the replat was recorded in the Office of the County Clerk of Nueces County. Texas, on April 15. 1976, removing the restrictions established and amended by Ordinance No. 5347 and Ordinance No. 5442; WHEREAS, the City Council finds that it is in the best interest of the City to repeal the ordinances that form the basis of the cloud on the title NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 5347, adopted on May 6.1959, and Ordinance No. 5442. adopted on July 29, 1959. amending the restrictions relating to Block A, Parkdale Shopping Center are hereby repealed. SECTION 2. That upon written request of the Mayor or five council members. copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure this the 25th day of October. 2005, C :documents&settings\garyws\agenda \2005\ I 025\ordrepealords534 7 &5442 ')2h~:.,if) ATTEST: ~ ,. .
