Home My WebLink About026791 ORD - 05/23/2006Page 1 of 3 AN ORDINANCE AMENDING THE CITY'S COMPREHENSIVE PLAN BY AMENDING THE MASTER SANITARY SEWER PLAN (MASTER SANITARY SEWER PLAN FOR THE SOUTHERN PORTION OF CORPUS CHRISTI) AND RESCINDING THE SPA 30 SUB BASIN SANITARY SEWER MASTER PLAN, BY APPROVING AND ADOPTING THE WASTEWATER COLLECTION SYSTEM MASTER PLAN, OSO W.R.P. SERVICE AREA, SUB BASIN SPA 30; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the adoption of the Wastewater Collection System Master Plan, Oso W.R P Service Area, Sub Basin SPA 30: WHEREAS, with proper notice to the public, public hearings were held on Wednesday, May 17, 2006, during a meeting of the Planning Commission, and on Tuesday, May 23, 2006 during a meeting of the City Council, in the Council Chambers, at City Hall, in the City of Corpus Christi, during which all interested persons were allowed to appear and be heard and WHEREAS, the City Council has determined that this adoption would best serve public health necessity, and convenience, and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City's Comprehensive Plan is amended by amending the Master Sanitary Sewer Plan, adopted July 27, 1983 by Ordinance No. 17743 (Master Sanitary Sewer Plan for the Southern Portion of Corpus Christi) and the Wastewater Collection System Master Plan, Oso W.R.P Service Area, Sub Basin SPA 30 is approved and adopted, and made a part of the Comprehensive Plan of the City of Corpus Christi, as shown in Attachment 1 which is attached to and incorporated into this ordinance. A copy of the Wastewater Collection System Master Plan, Oso W.R.P. Service Area, Sub Basin SPA 30 is on file with the City Secretary. SECTION 2. That any ordinance or part of any ordinance in conflict with this ordinance is expressly repealed by this ordinance. SECTION 3. The City Council intends that every section, paragraph, subdivision, clause, phrase word or provision of this ordinance shall be given full force and effect for its purpose. Therefore if any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance is held invalid or unconstitutional by final judgment of a court of competent jurisdiction, that judgment shall not affect any other section, paragraph, subdivision, clause, phrase. word or provision of this ordinance. \LEG -DIR \Jeannie \Gary' .Ord- amendMasterP!an2A do( V�: b iu t Page 2 of 3 SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 5. That upon written request of the Mayor or five Council members, copy attached the City Council (1) finds and declares an emergency due to the need for Immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed upon first reading as an emergency measure on this 23rd day of May. 2006.
