HomeMy WebLinkAbout026878 ORD - 07/18/2006ORDINANCE APPROVING A $5,000,000 TRANSFER FROM STREET 2005 CAPITAL IMPROVEMENT PROGRAM FUND NO. 3541 TO AND APPROPRIATING IN THE WATER 2006 CAPITAL IMPROVEMENT PROGRAM FUND NO. 4090; A $5,000,000 TRANSFER FROM STREET 2005 CAPITAL IMPROVEMENT PROGRAM FUND NO. 3541 TO AND APPROPRIATING IN THE WASTEWATER 2006 CAPITAL IMPROVEMENT PROGRAM FUND NO. 4250; AND A $2,000,000 TRANSFER FROM STREET 2005 CAPITAL IMPROVEMENT PROGRAM FUND NO. 3541 TO AND APPROPRIATING IN THE STORMWATER 2006 CAPITAL IMPROVEMENT PROGRAM FUND NO. 3492 FOR PROJECTS RELATED TO THE IMPROVEMENTS AND EXTENSIONS TO THE WATER, STORMWATER, AND WASTEWATER SYSTEMS; AMENDING FY 2004 -2005 CAPITAL BUDGET ADOPTED BY ORDINANCE 026188 BY INCREASING APPROPRIATIONS BY $12,000,000; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That $5,000,000 is transferred from Street 2005 Capital Improvement Program Fund No. 3541 to and appropriated in the Water 2006 Capital Improvement Program Fund No. 4090: $5,000,000 is transferred from Street 2005 Capital Improvement Program Fund No. 3541 to and appropriated in the Wastewater 2006 Capital Improvement Program Fund No. 4250; and $2,000,000 is transferred from Street 2005 Capital Improvement Program Fund No. 3541 to and appropriating in the Stormwater 2006 Capital Improvement Program Fund No. 3492 for projects related to the improvements and extensions to the Water, Stormwater, and Wastewater systems. SECTION 2. Upon receipt of bond proceeds from the sale of City of Corpus Christi Utility System Revenue Bonds anticipated to occur in first quarter of Fiscal Year 2006- 2007, all monies transferred as authorized in Section 1 shall be returned to the Street 2005 Capital Improvement Program Fund. The City finds, considers, and declares that the reimbursement of the City for the payment of such expenditures is and will be appropriate and consistent with the lawful objectives of the City and, as such, chooses to declare its intention, in accordance with the provisions of Section 1.150 -2 of the Treasury Regulations, to reimburse itself for such payments at such time as it issues City of Corpus Christi Utility System Revenue Bonds. SECTION 3. That FY 2004 -2005 Capital Budget adopted by Ordinance 026188 is amended by increasing appropriations by $12,000,000. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs f'2 S7R and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordina . is passe nd takes effect upon first reading as an emergency measure this the day of , 2006.
