HomeMy WebLinkAbout026921 ORD - 08/22/2006Page 1 of 3 ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, CHAPTER 53 (TRAFFIC) BY ADDING SECTION 53- 177, (CERTAIN VEHICLES PROHIBITED FROM ENTERING AND PARKING IN CERTAIN PACKERY CHANNEL AREA PARKING LOTS), RENUMBERING SECTIONS 53 -259 THROUGH 53 -266 (UNDER ARTICLE IX, VISION AND PASSAGE OBSTRUCTIONS) AS SECTIONS 53 -260 THROUGH 53 -267; AMENDING ARTICLE VIII (SCHEDULES) BY ADDING A NEW SECTION 53 -259 ( PACKERY CHANNEL PARKING LOTS RESTRICTIONS); PROVIDING FOR PENALTIES; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Chapter 53 of the Code of Ordinances is amended by adding section 53 -177 to read as follows: "Sc. 53 -177. Certain vehicles prohibited from entering and parking in certain Packers Channel area parking lots. No person shall enter, park, or operate any commercial vehicle, trailer, semitrailer, pole tra,er, house trailer, farm tractor, truck - tractor, road - tractor, tow truck, or any vehicle with a grts weight in excess of two tons, at any time, in the Packery Channel area parking Tots described in Schedule X, as set forth in section 53 -259, unless a parking permit issued for a spacial event or purpose shall have been obtained from the director of traffic engineering. This section shall not apply to persons, operations, or vehicles permitted to enter, park, or operate in a Packery Channel area parking lot in the performance of their duties under the auority and provisions of this Code. This section shall not apply to persons entering, parking, or operating the following types of motor vehicle, including but not limited to: authorized emergency vehicles, Tight trucks, pa►senger cars, towable recreational vehicles, travel trailers that are driven for personal use, capping trailers, truck campers, recreational vehicles that are driven for personal use, and passenger vehicles towing a personal boat, watercraft, water skis, surfboards, or similar recreational devices. As used in this section, the words "trailer," "semitrailer," "pole trailer," "house trailer," "f2 m tractor," "towable recreational vehicle," "authorized emergency vehicle," "light truck," "p4ssenger car," "motor vehicle," "recreational vehicle," "truck- tractor," "road- tractor," and "tow trtk," shall be interpreted as defined by Sections 541.201, 552.004, and 642.001 of the Texas Transportation Code. As used in this section, the words "commercial vehicle" shall be interpreted to mean any rltor vehicle (other than a motorcycle) designed and constructed for the transportation, delivery, or pick up of heavy, bulky, or other commercial product or materials, whether or not the H '.i..EG- DIR \VeronicaO\ ENGINEERING \TRAFFIC \ORD sec.53- 177sec.53 -259, revised on 072006 doc Page 2 of 3 vehicle has the name of the firm permanently affixed, painted or inscribed on either side of the vehicle. SECTION 2. Article IX (Vision and Passage Obstructions) of Chapter 53 of the Code of Ordinances is amended by renumbering sections 53 -259 (Definitions) through section 53- 2E (Penalty) as sections 53 -260 (Definitions) through section 53 -267 (Penalty). SECTION 3. Article VIII (Schedules) of Chapter 53 (Traffic) of the Code of Ordinances is amended by adding section 53 -259 to read as follows: "c. 53 -259. Schedule X -- Certain vehicles prohibited from parking in certain Packers Channel area parking lots. In occordance with section 53- 177and subject to the definitions, exceptions, and limitations in thsiff section, and when signs are erected giving notice thereof, no person shall enter, park, or operate any commercial vehicle, trailer, semitrailer, pole trailer, house trailer, farm tractor, truck - trator, road - tractor, tow truck, or any vehicle with a gross weight in excess of two tons, at any time, in the following Packery Channel area parking lots: (1) Packery Channel South Parking Lot, located at Windward Drive and St. Augustine Drive, being part of Padre Island Section A, Lots 13, 14, and 15, Block 45. (2) Packery Channel North Shore Parking Lot, located at 14613 Zahn Road (temporary address), being part of a 684.480 portion of State Tracts Numbers 51, 60, 61 Laguna Madre, 907S, 908S, 915 S, 916S Gulf of Mexico; and Tracts Numbers 1, 4, and 5, GLO School File No. 153534, Nueces County, Texas. SECTION 4. A violation of this ordinance is punishable under section 1 -6 of the Code of Ordinances. SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 6. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
