HomeMy WebLinkAbout027047 ORD - 11/14/2006AN ORDINANCE AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE A SHORT TERM LEASE AGREEMENT, NOT TO EXCEED ONE (1) YEAR, WITH CHET RASBERRY, IN CONSIDERATION OF LESSEE'S MAKING IMPROVEMENTS TO THE LEASED STRUCTURES OF A MINIMUM VALUE OF $50,000 AND AN ANNUAL RENTAL FEE OF $0.17 PER SQUARE FOOT, TO OPERATE A HELICOPTER MAINTENANCE FACILITY AND HELICOPTER CHARTER OPERATION ON 91,250 SQUARE FEET OF LAND AND IMPROVEMENTS LOCATED AT CORPUS CHRISTI INTERNATIONAL AIRPORT; AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi and Chet Rasberry desire to enter into a written lease for approximately 91, 250 square feet of land which includes building and hangar irprovements and vehicle parking areas; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. The City Manager, or his designee, is authorized to execute a short -term lease agreement, not to exceed one (1) year, with Chet Rasberry in consideration of lessee's making improvements to the leased structures of a minimum value of $50,000 and an annual rental fee of $0.17 per square foot, to operate a helicopter maintenance facility and helicopter charter operation on 91,250 square feet of land and improvements located at Corpus Christi International Airport. The Lease Agreement shall be in s.tstantially the same format and content as attached in Exhibit "A ". SECTION 2. That upon written request of the Mayor or five Council members, copy atched, the City Council (1) finds and declares an emergency due to the need for irnediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure this the )L/th. day of ,kJ ve n.JaeY , 2006. Kinnison Jesse Noyola (*ark Scott L 027047 SHORT TERM LEASE AGREEMENT WITH CHET RASBERRY THE STATE OF TEXAS § KNOW BY ALL THESE PRESENTS: COUNTY OF NUECES § This Lease Agreement is entered into this the day of , 2006 between the City of Corpus Christi, a Texas municipal corporation, ( "City" or "Lessor ") acting through its duly authorized representative the City Manager, or designee, ( "City Manager "), PO Box 9277, Corpus Christi, Nueces County, Texas 78469 -927 7, and Chet Rasberry ( "Lessee "), a natural person. 17177 Navajo Road, Apple Valley, California 92307. City and Lessee, in consideration of faithful performance of the covenants herein, agree as follows: 1. Premises. City leases to Lessee the land located to the northeast side of the Corpus Christi International Airport terminal building as more particularly described in the attached and incorporated Exhibit A ( "Premises "). The Premises includes approximately 91 ,250 square feet of land, together with improvements, easements, access for ingress and egress. and parking areas. 2. Use of Premises. Lessee must use the Premises for the purposes of a helicopter maintenance facility and helicopter charter operations, and for no other purpose without the express written consent of City Manager. Lessee must supply services on a fair, equal and nondiscriminatory basis to all users thereof. 3. Term. This Lease Agreement is to commence upon the date of execution of this agreement, for a period not to exceed one year. This Lease Agreement shall expire sixty (60) days after final approval by City Council of the long term lease executed concurrently herewith. 4. Rental. Lessee must pay the City the Ground Rent as calculated and set out in the Long Term Lease Agreement. The Ground Rent is due on or before the 1st day of the month for the current month's rent. The rental fees are payable to the Corpus Christi International Airport, 1000 International Drive, Corpus Christi, Texas 78406. 5. Terms and Conditions. All other Terms and Conditions of the Long Term Lease Agreement (titled Ground Lease at Corpus Christi International Airport between the City of Corpus Christi and Chet Rasberry) executed by Lessee concurrently herewith are incorporated herein for all purposes, as if fully attached hereto, EXECLTED IN DUPLICATE ORIGINALS this day of , 2006, by the authorized representative of the parties.
