RESOLUTION
AUTHORIZING THE CITY MANAGER TO EXECUTE A
MEMORANDUM OF AGREEMENT WITH THE U.S.
ENVIRONMENTAL PROTECTION AGENCY AND THE TEXAS
COMMISSION ON ENVIRONMENTAL QUALITY PROVIDING
FOR THE IMPLEMENTATION OF LOCALLY DEFINED
EMISSION CONTROL PROGRAMS SHOULD THE EIGHT-HOUR
FEDERAL OZONE STANDARD BE VIOLATED IN LIEU OF
IMMEDIATE REDESIGNATION TO NON -ATTAINMENT.
WHEREAS, the Corpus Christi urban airshed comprised of Nueces and San
Patricio counties experiences episodes of elevated ozone levels and at times the
recorded levels approach the federal eight-hour standard of 0.08 parts per
million; and
WHEREAS, should the area be designated as non -attainment of the standard
resulting in control mandates from the state and federal governments, it would
result in expensive control requirements being required of industries located in
the area and considering moving to the area, and would also negatively impact
the public; and
WHEREAS, the Corpus Christi Air Quality Committee developed a program with
the U S. Environmental Protection Agency (EPA) and the Texas Commission on
Environmental Quality (TCEQ) which allows an area to develop control strategies
unique to the area that most effectively reduce ozone levels in the airshed.
MOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. that the City Manager is authorized to execute a Memorandum of
Agreement with the U.S. Environmental Protection Agency and the Texas
Commission on Environmental Quality providing for the implementation of locally
defined emission control programs.

For the reasons set forth in the emergency clause of the foregoing ordinance an
emergency exists requiring suspension of the Charter rule as to consideration and
voting upon ordinances at two regular meetings: I/we, therefore, request that you
suspend said Charter rule and pass this ordinance finally on the date it is introduced, or
at the present meeting of the City Council.
