HomeMy WebLinkAbout027337 ORD - 07/17/2007Page 1 of 3 AN ORDINANCE AMENDING ARTICLE 7 '"R-2' MULTIPLE DWELLING DISTRICT REGULATIONS," SECTION 7-1 OF THE ZONING ORDINANCE, TO ALLOW A MINIMUM OF TWO -UNIT TOWNHOUSE STRUCTURES WITHIN A SINGLE PLATTED LOT; PROVIDING FOR SEVERANCE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY WHEREAS, with proper notice to the public, public hearings were held on Wednesday, May 30, 2007 and on June 13, 2007, during meetings of the Planning Commission, and on Tuesday, July 17, 2007, during meetings of the City Council, in the Council Chambers, at City Hall, in the City of Corpus Christi, during which all interested persons were allowed to appear and be heard; WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the proposed text amendment to the City of Corpus Christi Zoning Ordinance; and WHEREAS, the City Council has determined that this ordinance would best serve public health, necessity, and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Article 7 "R-2' Multiple Dwelling District Regulations," Section 7-1 of the Zoning Ordinance is amended to read as follows: "Sec. 7-1. The regulations set forth in this article, or set forth elsewhere in this Ordinance when referred to in this article, are the regulations in the "R-2" Multiple Dwelling District. The purpose of this district is to maintain a generally spacious residential environment but at the same time permit a variety of housing types. Population density and height of buildings are low enough to be compatible with neighboring single-family development. Permitted community facilities are the same as for the one -family districts. A minimum of two --unit townhouse structures is permitted per platted property provided each townhouse unit is incompliance with the current building code, as amended." If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. A violation of this ordinance or requirements implemented under this ordinance constitutes an offense punishable under Section 1-6 of the City Code of Ordinances. SECTION 4. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 5. That upon written request of the Mayor or five Council members, copy attached, the City Council finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and suspends the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed upon first reading as an emergency measure on this 17th day of July, 2007.
