"MINIMUM STANDARDS" OF THE PLATTING ORDINANCE TO REQUIRE LOOPED WATER LINES AND PROVIDE FOR THE DEFINITIONS RELATED THERETO; PROVIDING A REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the installation of dead-end lines places an unreasonable operational burden on the City's Water Department and requires an unnecessary waste of treated water in order to maintain the system; WHEREAS, with proper notice to the public, public hearings were held on Wednesday, January 9, 200 8, and January 23, 200 8, during meetings of the Planning Commission, and on Tuesday, January 29, 200 8, during a meeting of the City Council, in the Council Chambers, at City Hall, in the City of Corpus Christi, during which all interested persons were allowed to appear and be heard; and WHEREAS, the City Council has determined that this amendment would best serve public health, necessity, and convenience and the general welfare of the City ofCorpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION I. That Section V.13.5. "Waterlines" ofthe Platting Ordinance" is amended t read as follows: "V. B. 5. Waterlines. V. B. 5. a) Where an approved treated water supply main of sufficient icient capacity as determined by the Water Superintendent is available within one (1) mile of the property being platted, irrespective oflocation within or without the city limits, each lot within the subdivided area shall be provided with access to such water supply. The water system shall be designed in accordance with the Distribution System Standards published by the Water Division, Corpus Christi, Texas, in effect at the time of commencement of water system construction. SECTION . That all ordinances or parts ofordinances in conflict with this ordinance are hereby expressly repealed. SECTION 3. If, for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of the City Council that every section, paragraph, subdivision, phrase, word and provision hereof shall be given full force and effect for its purpose. SECTION 4. A violation of this ordinance or requirements implemented under this ordinance constitutes an offense punishable under Section 1-6 of the City Code ofOrdinances. SECTION 5. That publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter ofthe City of Corpus Christi. SECTION 6. This ordinance shall take effect upon and after publication of this ordinance.
