RESOLUTION
EXEMPTING SOUTH PRAIRIE ESTATES UNIT 2, LOCATED
APPROXIMATELY TWO MILES OUTSIDE THE CITY LIMITS, SOUTH
OF OSO CREEK, AND WITHIN THE CITY'S EXTRATERRITORIAL
JURISDICTION, FROM PAYMENT OF WATER AND WASTEWATER
ACREAGE FEES PURSUANT TO SECTIONS V. B. 5.k) AND V. B. 6.1)
OF THE PLATTING ORDINANCE
WHEREAS, South Prairie Estates Unit 2 (Subdivision) is located outside the city limits
of the City of Corpus Christi and is not currently served by the City water or wastewater
system;
WHEREAS, the owners, Abel and Cynthia Garza and John and Linda Mikulencak, have
submitted a written request to exempt the Subdivision from the payment of water and
wastewater acreage fees based on the determination that it is not likely that the area will
be served by City water or wastewater service within the next fifteen (15) years;
WHEREAS, based on Sections V. B. 5. k. and V. B. 6. I. of the Platting Ordinance of the
City of Corpus Christi, City staff and the Planning Commission recommend that City
Council find that it is not likely that the area will be served by City water or wastewater
service with in the next fifteen (15) years and that the Subdivision be exempt from the
payment of water and wastewater acreage fees at this time.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That it is determined that South Prairie Estates Unit 2 is not likely to
be served by City water or wastewater service with in the next fifteen (15) years and is
exempt from the payment of water and wastewater acreage fees at this time, pursuant
to Sections V. B. 5. k. and V. B. 6. I. of the Platting Ordinance of the City of Corpus
Christi, subject to the owner of the Subdivision entering into a Water and Sanitary
Sewer Connection Agreement.
SECTION 2. That the Water and Sanitary Sewer Connection Agreement will
require payment of the water or wastewater acreage fees if water or wastewater
services become available to the property within the next fifteen (15) years, based on
the fee rates applicable at that time.
SECTION 3. That the Water and Sanitary Sewer Connection Agreement must
be recorded in the county records prior to the recordation of the plat.
