HomeMy WebLinkAbout027617 ORD - 03/25/2008Page 1 of 4 AN ORDINANCE AMENDING THE ZONING ORDINANCE, UPON APPLICATION BY ROBERTO CARDENAS, BY CHANGING THE ZONING MAP IN REFERENCE TO BASS SUBDIVISION, LOT E, BLOCK 28, FROM "R - 1B" ONE -FAMILY DWELLING DISTRICT TO "R-1B/PUD-2" ONE - FAMILY DWELLING DISTRICT WITH A PLANNED UNIT DEVELOPMENT -2 OVERLAY, SUBJECT TO TWELVE (12) CONDITIONS; AMENDING THE COMPREHENSIVE PLAN TO ACCOUNT FOR ANY DEVIATIONS FROM THE EXISTING COMPREHENSIVE PLAN; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Roberto Cardenas, for amendment to the City of Corpus Christi Zoning Ordinance and Zoning Map; WHEREAS, with proper notice to the public, public hearings were held on Wednesday, February 20, 2008, during a meeting of the Planning Commission, and on Tuesday, March 25, 2008, during a meeting of the City Council, in the Council Chambers, at City Hall, in the City of Corpus Christi, during which all interested persons were allowed to appear and be heard; and WHEREAS, the City Council has determined that this amendment would best serve public health, necessity, and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by changing the zoning on Bass Subdivision, Lot E, Block 28, located on Sandra Lane approximately 1500 feet east of Airline Road, from "R -1B" One -family Dwelling District to "R-1B/PUD-2" One -family Dwelling District with a Planned Unit Development -2 Overlay, subject to the following twelve (12) conditions: (Zoning Map 042032) (Exhibit) 1. Development Plan: The property shall be developed subject to the design features and elements contained in the Angel Cove Development Plan. 2. Height: Buildings shall not exceed one-story in height. 3. Density: The density of the development shall not exceed 9.9 dwelling units per acre. Parking: Each dwelling unit shall provide two parking spaces within a garage. A total of eighteen (18) visitor parking spaces shall be provided as indicated in the Development Plan. 5. Setbacks: A minimum twenty (20) foot front yard setback shall be provided along Sandra Lane. A minimum ten (10) foot side yard and rear yard setback shall be provided. 6. Screening Fence: A solid wood screening fence with a height of not less than six (6) feet shall be provided along the north, west and east property lines. 7. Lighting: Outdoor lighting shall be shielded and directed away from adjacent single family residences with no more than two foot-candles at all property lines. 8. Landscaping: Eight 2 -inch caliper trees shall be provided along Sandra Lane as shown on Exhibit B of the Development Plan. Landscaping shall not be located within utility easements. Additional landscaping may be required in compliance with Article 27B, Landscape Requirements of the Zoning Ordinance. 9. Fire Lane: The private drive shall be striped to indicate "Fire Lane/No Parking" as shown on Exhibit A of the Development Plan. A forty-two (42) foot diameter turnaround shall be provided at the terminus of the private drive as shown on Exhibit A of the Development Plan. 10. Fire Rated Walls: Construction shall comply with International Residential Code (IRC) required 2 -hour fire rated walls between attached dwelling units. 11. Fire Flow Test: Prior to recordation of the plat, a certified fire flow test indicating a fire flow of 1,500 gallons per minute with a residual pressure of 20 pounds per square inch shall be submitted to Development Services. 12. Time Limit: Construction of the townhouse development shall commence within two (2) years from the approved ordinance date of the "PUD -2" Overlay and construction shall be completed within three (3) years from the approved ordinance date of the "PUD -2" Overlay, or the "PUD -2" expires. SECTION 2. That the official Zoning Map of the City of Corpus Christi, Texas, is amended to reflect the amendment to the Zoning Ordinance made by Section 1 of this ordinance. SECTION 3. That the Zoning Ordinance and Zoning Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as changed by this ordinance and any other ordinances adopted on this date, remain in full force and effect. That to the extent that this amendment to the Zoning Ordinance represents a deviation from the Comprehensive Plan, the Comprehensive Plan is amended to conform to the Zoning Ordinance, as amended by this ordinance. SECTION 5. That all ordinances or parts of ordinances in conflict with this ordinance are hereby expressly repealed. SECTION 6. A violation of this ordinance or requirements implemented under this ordinance constitutes an offense punishable under Section 1-6 of the City Code of Ordinances. SECTION 7. That publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 8. That upon written request of the Mayor or five Council members, copy attached, the City Council finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and suspends the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed upon first reading as an emergency measure on this 25th day of March, 2008. Zoning change request — see attached copy of letter sent to the City of Corpus Christi. Texas Gulf Investments, Inc. is requesting a zoning change from a R 1B to a R 1B/PUD-2, a one family dwelling district with a planned unit development overlay -2. II. Development plan - a. Uses — The sole purpose of the planned unit development will be for the use of single family residential occupancy. b. Height -- Please reference sheet 2 of the architectural drawings. We propose a one story building, with the highest level at 16' feet 8" inches. c. Density — The property surrounding this proposed planned development consists of other residential and commercial property. We propose 18 units on 1.82 acres for a density of 9.9 dwelling units per acre. This is compatible with densities of existing residential development. d. Parking — Refer to exhibit "A". In reference to Residential parking, we have a total of 36 residential parking spaces, 2 required spaces per unit in the form of a 2 car garage provided to residents. Visitor parking, we have a total of 18 spaces provided, 1 space available per residence of this planned unit development. In reference to the Fire lane, we have a dedicated 20' foot wide fire lane within the private drive and have provided a 42' foot diameter for fire apparatus turnaround as per the fire marshals request. e. Pedestrian Access — Reference exhibit "B". Pedestrian access is provided through the showed driveway £ Common area — Reference exhibit "B". The total acreage of common area for this planned unit development is 26,476.55 square feet, or 0.61 acres. Setbacks — Reference exhibit "C". As shown, there is a 25' foot street dedication, an additional 5' foot right of way and a 20' foot building setback line for the front of the planned unit development. There are 10' foot utility easement setback lines for either side of the planned unit development. There is a 55' drainage easement across the rear of the planned unit development. h. Trash Collection — Reference exhibit "B". There is a designated trash area only on the days that trash collection will be picked up by the City of Corpus Christi. Each resident will be responsible for getting a trash can from the City of Corpus Christi solid waste department. g. i. Fence — Reference exhibit "B". A 6' foot wood privacy fence will be provided around the perimeter of the development. j. Floor plan types — Reference sheet 5 for Floor plan — unit A and sheet 7 for Floor plan — unit B. A total of 4 units for floor plan — unit A and a total of 14 units for floor plan — unit B. Floor plan — unit A consists of 1665.6 square feet and Floor plan — unit B consists of 1578.5 square feet. k. Building design elevations — Reference exhibit "D" and architectural sheet IE & 2E. There are 2 designs proposed for this planned unit development. Table of Contents 1. Land use compatibility statement — The planned unit development that 1 propose for my property on Sandra Lane is similar to the surrounding projects. Across the street of my proposed development is a commercial bank and at the end of the road is a single family housing subdivision. To the north of my proposed planned development is another existing single family subdivision. Our proposed planned unit development is a one story town home development. The height is compatible with existing single family development with a height not to exceed 16' feet 8" inches. We have set up our development in 4 different sections as to provide more common area for our residents. We have provided 26,476.55 square feet of common area. We also increased our setbacks than those required in R 1B, this includes 10' utility easements for the northeast and southwest sides of our planned unit development, a 55' drainage easement at the rear of our planned unit development, and 20' building setback line for the front of our planned unit development. m. Utilities — We are proposing 10' utility easements for the northeast and southwest sides of this planned unit development. There are existing water and sewer lines across the street of Sandra Lane. n. Fire Hydrant — Please reference exhibit "A" or "C". Placement of the fire hydrant is located next to north side of Section A (reference exhibit "D"). The fire hydrant will have adequate curb stops as to protect the hydrant from being hit by residents or visitors. o. Time limit — Reference letter addressed to the City of Corpus Christi. Attached to this letter you will find a copy of my proposed site plan that includes a 30' Right of Way dedication with a proposed landscape area on each side. My proposed development includes a total of 18 units. I do realize that averages 9.5 dwelling units per acre but as my site plan will show, I have a 34.1 foot common area in between the buildings and the required area for an emergency vehicle should the need become necessary. I also propose a 6' wooded privacy fence all around the property. My request is for a R-1.13/PUD-2 zoning, I do hope that the information provided shows my willingness to move this project forward. I am asking for a 2 year period for this special zoning request so that I may start construction. If you should have any questions, please feel free to give me a call.
