HomeMy WebLinkAbout027882 ORD - 09/30/2008AN ORDINANCE EXTENDING THE LOCAL STATE OF DISASTER DECLARED BY THE MAYOR ON SEPTEMBER 19, 2008 AND CONTINUED ON SEPTEMBER 26, 2008; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Governor of the State of Texas on September 8, 2008, under the authority of the Texas Disaster Act of 1975, proclaimed that Hurricane Ike poses a threat of imminent disaster along the Texas Coast and Nueces County and emergency conditions for the people of the State of Texas, and directed that all necessary measures, both public and private as authorized under §418.015, Texas Government Code, be implemented to meet the disaster; and WHEREAS, on September 19, 2008, the Mayor issued a proclamation declaring a state of disaster for the City of Corpus Christi as a result of loss of property from flood, wave action and storm surge from Hurricane Ike; and WHEREAS, on September 26, 2008, the Mayor continued the local state of disaster since damage assessment continued and extraordinary measures were still needed to respond to the impacts of Hurricane Ike and its debris that continued to wash upon our beaches; and WHEREAS, Section 16-3(c), Code of Ordinances, City of Corpus Christi, allows the Mayor to continue or renew a local state of disaster for an additional period of seven (7) days, but thereafter, the consent of City Council is required; and WHEREAS, the City Council has determined that extraordinary measures must be continued to rehabilitate property and to address the impacts of Hurricane Ike; and WHEREAS, the conditions necessitating declaration of a state of disaster continue to exist; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the state of disaster declared by the Mayor on September 19, 2008, and extended on September 26, 2008, shall continue until terminated by order of the City Council. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. 027882 IKE CC ORDINANCE EXTENDING LOCAL DISASTER SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure on this the 30th day of September, 2008.
