AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE AN
AMENDMENT TO LEASE AGREEMENT WITH THE BUCCANEER
COMMISSION, INC. ("COMMISSION") FOR 2009 BUCCANEER DAYS
FESTIVAL AND RELATED ACTIVITIES, TO REDUCE AMOUNT OF COSTS
PAID BY THE COMMISSION FOR CITY SERVICES TO $'17,'150.00; AND
DECLARING AN EMERGENCY.
BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager or his designee is authorized to execute an amendment to the
lease agreement with the Buccaneer Commission for 2009 Buccaneer Days Festival and related
activities. The amendment will provide for reduction in the amount of costs paid by the Buccaneer
Commission for City services. The Commission will pay the City the amount of $17,150.00 for City
services provided for the 2009 Buc Days events. A copy of the amendment is attached and will be
filed with the City Secretary.
SECTION 2. That upon written request of the Mayor or five Council members, copy attached, the City
Council (1) finds and declares an emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs and (2) suspends the Charter rule that requires
consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed
and takes effect upon first reading as an emergency measure this the 8th day of September, 2009.

AMENDMENT NO. 1 TO BUC DAYS SHORT TERM 2009 LEASE
AGREEMENT
This Amendment to the Buc Days Short Term Lease Agreement is made and
entered into this day of , 2009, by the City of Corpus Christi, a municipal
corporation and political subdivision of the State of Texas, hereinafter referred to
as "CITY," and the Buccaneer Commission, Inc. ("Commission");.
Whereas, the parties previously entered into Agreement approved by City
Council on April 14, 2009 under Ordinance No. 028110 regarding the 2009 Buc
Days events ("Event");
Whereas, the Agreement originally provided for the Commission to pay the City
100% of all non -police City costs, and 50% of police overtime costs provided for
the Event;
Whereas, the parties desire to amend the agreement to reduce the amount of
costs paid by the Commission for the Buc Days 2009 event, due to unforeseen
reduced attendance;
NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1) Section 7 of the Agreement is hereby revised as follows:
"7. Payment of City Costs.
. For Buc Days 2009
event, the Commission will pay the City the sum of $17,150.00 as payment in full
for all services provided by the City for the Event. The Commission will make
this payment within 30 days of receipt of invoice from the City.

2) All other terms and conditions of the previously executed Agreement
between the parties which are not inconsistent herewith shall continue in full
force and effect.
EXECUTED IN DUPLICATE ORIGINALS this day of , 2009, by
