HomeMy WebLinkAbout028434 ORD - 12/08/2009ORDINANCE CHANGING THE DATE OF CITY OF CORPUS CHRISTI CITY COUNCIL ELECTIONS FOR 2011 AND SUBSEQUENT YEARS FROM THE FIRST SATURDAY IN APRIL TO THE MAY UNIFORM ELECTION DATE, WHICH IS THE SECOND SATURDAY IN MAY; AND ADJUSTING THE CITY COUNCIL TERMS OF OFFICE TO CONFORM TO THE NEW ELECTION DATE. Whereas, the City Council elections have previously been held on the first Saturday in April in odd numbered years, as authorized by Article II of the City Charter, and Section 41.0051 of the Texas Election Code; Whereas, on May 25, 2009, the Texas Legislature approved HB 1945, which took effect on September 1, 2009; Whereas, HB 1945 repealed Section 41.0051 of the Texas Election Code; Whereas, HB 1945 requires that not later than December 31, 2009, the governing body of the City of Corpus Christi must choose a Uniform Election Date for its general election for officers in 2011 and subsequent years; Whereas, HB 1945 provides in Section 2 that the governing body of a political subdivision required to change its election date under HB 1945 shall adjust the terms of office to conform to the new election date. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That the City Council chooses the second Saturday in May, which is a Uniform Election Date under Section 41.001 of the Texas Election Code, as the date of for its general election for officers for 2011 and subsequent years. Section 2. That the two-year terms of office for the City Council as established by City Charter Article II Section 1(b) shall be adjusted to conform to the new election date as required by Section 2 of HB 1945. Section 3. This ordinance takes effect upon second reading.
