HomeMy WebLinkAbout028696 ORD - 07/20/2010AN ORDINANCE AMENDING SECTION 3 Y2-2, CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, RELATING TO THE FEES CHARGED FOR ALARM SYSTEMS; PROVIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. Section 3 1/2-2 is revised to read as follows: °•=7, See. 3 1/2-2required; fees. "(a) The Corpus Christi Police Department will not respond to any alarxti notification from an al*itt site that does not have a valid ptiit unless the 0,-, ov notification was a duress 41ailM, a hold-up aka* a panic 046, or reported to a 9-1-1 emergency telephone number by a person other than an OM company. "(b) A person commits an offense if the person operates, or causes or allows to be operated, an rrn Department system on premises under the person's control or ownership or at its ORM site without a valid im issued by the Corpus Christi Police Department. The Corpus Christi Police and Corpus Christi police officers are authorized to enforce this provision, and to issue citations for violations. "(c) A separate 0,010 is required for each 410M site and for each4:M unit. No exemptions shall apply except as required by federal or state law. The burden of proof shall be with the person asserting the exemption. "(d) The annual, nonrefundable fee for an 44* peihft is twenty thirty-five dollars ($2-5,00 $35 00) for residential and fifty sixty dollars ($5-0700 $60.00) for commercial. "(e) A permit is valid for one (1) year from the date of its issuance, and may be renewed every year upon submission of a renewal invoice. It is the responsibility of the It holder to submit a renewal invoice ten (10) days prior to the 0!.:!jri:4 expiration date. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision of this ordinance be given full force and effect for its purpose. SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 4.
