HomeMy WebLinkAbout028727 RES - 08/17/2010Page 1of2 RESOLUTION APPROVING THE PROTOCOL TO BE USED TO AUTHORIZE THE CITY MANAGER TO UTILIZE THE BRUSH COLLECTION RAPID RESPONSE FUND APPROVED IN THE FISCAL YEAR 2010-2011 BUDGET. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The Brush Collection Rapid Response fund approved in the Fiscal Year 2010-2011 budget may be used as follows: A. The funds may be utilized for the intended use by staff if:. (1) There is imminent landfall of a weather event that may create a hazardous condition if the brush set out by residents creates a safety or health risk to citizens of Corpus Christi; or (2) A post weather event condition requires clearance of excessive brush and or debris that creates a safety or health risk to the citizens of Corpus Christi; or (3) Due to any other unanticipated need or cause, there exists a backlog of brush to be collected that may not be eliminated by employing the resources dedicated in the current or future operating budget for brush collection services and creates a safety or health risk to citizens of Corpus Christi. B. The funds may be used to fund a contract with the City's pre -positioned contractor for brush removal, or if staff determines that a more cost effective contract may be procured, then an alternate contractor may be used, if a condition listed under item A is met. C. If the funds are appropriated for the intended use and a contractor is selected, staff will be responsible for developing a schedule which identifies the services to be procured, schedule to be adhered to by city and contractor staff, and the expected timeline for the city to return to its normal bush collection schedule. D. Staff will provide to Council a monthly update of progress achieved regarding the brush collection services delivered and adherence to the schedule provided under subsection C. E. If, due to events beyond the control of staff, any emergency situation exists where immediate contactor services must be acquired for the protection of the health and safety of the citizens of Corpus Christ, then the City Manager may 025727 H:\LEG-1DIRIl.isa12010 ResolutionslEmergency Brush Pickup.doc INDEXED Page 2 of 2 utilize the funds to employ the emergency powers granted under emergency contracting authority governed by existing City ordinance. F. Protocol will be subject to change modification as directed by City Council, SECTION 2. This Resolution shall take effect and be in full force immediately after its adoption by the City Council.
