HomeMy WebLinkAbout029119 ORD - 07/12/2011ORDINANCE AUTHORIZING THE CITY MANAGER, OR DESIGNEE, TO EXECUTE A FIVE-YEAR USE PERMIT WITH SUNDANCE FUELS, LTD. FOR THE USE OF COOPER'S ALLEY L -HEAD FOR THE PURPOSE OF OPERATING A MARINE FUEL STATION FOR MONTHLY RENTAL PAYMENTS OF $200.00; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Manager, or his designee, is authorized to execute a five-year use permit with Sundance Fuels, Ltd. for the use of Cooper's Alley L -Head for the purpose of operating a Marine Fuel Station for monthly rental payment of $200.00. A copy of the agreement shall be filed with the City Secretary. SECTION 2. If, for any reason, any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of the City Council that every section, paragraph, subdivision, phrase, word and provision hereof shall be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, the City Council (1) finds and declares an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure this the f Z day of , 2011.
