HomeMy WebLinkAbout030195 RES - 06/10/2014RESOLUTION REGARDING THE MATTER OF THE 2014 NEGOTIATION PROCESS BETWEEN THE CITY OF CORPUS CHRISTI AND THE CORPUS CHRISTI PROFESSIONAL FIREFIGHTERS ASSOCIATION - LOCAL UNION 936 WHEREAS, the City of Corpus Christi (the City) and the Corpus Christi Professional Firefighters Association — Local Union 936 (the Fire Union) have been engaged in collective bargaining negotiations for a new fire contract since April 10, 2014 without resolving several issues thus far; and WHEREAS, the current "Agreement Between The City of Corpus Christi and The Corpus Christi Firefighters' Association, August 1, 2011 TO July 31, 2014" states on page 21, Article VII, UNION ACTIVITIES, Section 2. Negotiating Team., "...An negotiations shall be conducted exclusively between the designated bargaining representatives of the City and the Union. Neither party shall make any effort to bypass such representatives of the other party during collective bargaining for a new contract unless an impasse exists as defined in Section 174.152 of the Texas Local Government Code, V.T.C.A..."; and WHEREAS, during the collective bargaining negotiations for a new contract, the City of Corpus Christi and the Fire Union negotiated, agreed to and executed the "Ground Rules for 2014 Collective Bargaining Negotiations Between Corpus Christi Professional Firefighters Association — Local Union 936 and the City of Corpus Christi" of which states "9. All negotiations shall be conducted exclusively between the designated bargaining representatives of the City and the Union. Neither party shall make any effort to bypass such representatives of the other party during collective bargaining for a new contract unless an impasse exists as defined in Section 174.152 of the Texas Local Government Code, V.T.C.A. Nothing in this section shall be construed to preclude the Union bargaining team from communicating with its members or the City team from communicating with staff, the City Manager, and the City Council. "; and WHEREAS, the City negotiating team and the Fire Union negotiating team have designated their collective bargaining representatives in writing; and WHEREAS, the City and the City Council, as the governing body for the City of Corpus Christi, have committed to good faith collective bargaining with the Fire Union for a new agreement with the Fire Union that is fair, mutually agreeable, sustainable and fiscally responsible; and WHEREAS, the City Council desires to support and encourage the continued collective bargaining negotiations between the City and the Fire Union; and WHEREAS, if the negotiations are completed, the City Council must review, consent to and approve a new contract with the Fire Union; 030195 INDEXED NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: Section 1. To maintain the integrity of the collective bargaining process, the City Council, as the governing body for the City of Corpus Christi, is hereby committing to continue negotiating in good faith with the Fire Union and to continue honoring page 21, Article VII, UNION ACTIVITIES, Section 2. Negotiating Team. of the "Agreement Between The City of Corpus Christi and The Corpus Christi Firefighters' Association, August 1, 2011 TO July 31, 2014" as well as Rule Number 9 of the "Ground Rules for 2014 Collective Bargaining Negotiations Between Corpus Christi Professional Firefighters Association — Local Union 936 and the City of Corpus Christi" which state that "All negotiations shall be conducted exclusively between the designated bargaining representatives of the City and the Union. Neither party shall make any effort to bypass such representatives of the other party during collective bargaining for a new contract unless an impasse exists as defined in Section 174.152 of the Texas Local Government Code, V.T.C.A..." even after an impasse exists. Section 2. The City Manager and his designees are hereby authorized and encouraged to continue negotiating in good faith with the Fire Union. Section 3. If there is any need to respond to issues regarding the 2014 collective bargaining negotiations with the Fire Union, the City Council, as the governing body for the City of Corpus Christi, will respond through a designated spokesperson.
