HomeMy WebLinkAbout030430 ORD - 02/17/2015 ORDINANCE Ratifying and authorizing the City Manager to execute first amendments to the lease agreements with Southwest Airlines and Envoy Air (formerly known as American Eagle Airlines) to extend the term of the leases; authorizing and accepting an assignment of the lease from Envoy Air to American Airlines; providing for an effective date; providing for severance; and providing for publication. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Council ratifies and authorizes the City Manager, or his designee, to execute first amendments to the existing Airline Use and Lease Agreements with Southwest Airlines and Envoy Air, Inc., formerly known as American Eagle Airlines, Inc., in order to extend the terms of each respective lease through September 30, 2017, in consideration of the pay- ment of fees. SECTION 2. Concurrent with the authorization to execute the first amendment to the Airline Use and Lease Agreement with Envoy Air, Inc., the City Council authorizes and accepts an assignment of the lease from Envoy Air, Inc., to American Airlines, Inc., for all intents and purposes as expressed in the lease and first amendment. SECTION 3. This ordinance is effective on the 61st day following final approval by the City Council, in compliance with the City Charter of the City of Corpus Christi. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, or word of this ordinance is held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, or word of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, or word of this ordinance be given full force and effect for its purpose. SECTION 5. Publication will be made in the official publication of the City of Corpus Christi, the costs of which are payable by each tenant, as required by the City Charter of the City of Corpus Christi.
