Fund to John and Elizabeth Butler
WHEREAS, the current property owners owning at least 50 percent
(50%) of the relevant platted property have petitioned for a refund of the
wastewater lot/acreage fees originally paid for that property;
WHEREAS, the property does not currently have public wastewater
services available; and
WHEREAS, the property will not be served with public wastewater
services within the next 5 years.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. Making the above findings in accordance with Section 8.5.2.G. of
the Unified Development Code, City Council approves the refund of the
wastewater IoUacreage fee paid by the petitioner, John Butler and Elizabeth
Butler, with a 5.5 percent interest per annum.
SECTION 2. Funding in the amount of $13,006.92 is appropriated from the
No. 4220 Wastewater Trunk Line Trust Fund to refund John Butler and
Elizabeth Butler wastewater lot/acreage fees previously paid for Butler
Addition, Lot 1 in accordance with Section 8.5.2.G. of the Unified
Development Code. Furthermore, the City Manager or designee is
authorized to issue payment of the refund to the named parties contingent
on fund availability.
