HomeMy WebLinkAbout031453 ORD - 06/19/2018 Ordinance authorizing a 17-month lease agreement with Espejo Helicopters, LLC for use of area of The Water's Edge Park located along Shoreline Blvd. near Kinney Street to conduct helicopter air tours with monthly rent payment of five percent of gross revenues. Whereas, the City has received a request for use of portion of The Water's Edge Park located along Shoreline Blvd. near Kinney Street as a helicopter landing and take-off site for helicopter tours; and Whereas, prior to the use of park lands for non-park purposes, Chapter 26 of the Texas Parks and Wildlife Code requires the City to hold a public hearing to determine that there is no feasible and prudent alternative to the use of park lands; and Whereas, notices of the public hearing were published on May 20, May 27, and June 3, 2018 regarding a public hearing to be held during City Council meeting on June 12, 2018; NOW, THEREFORE, be it ordained by the City Council of the City of Corpus Christi, Texas, that: Section 1. That the City Council held a public hearing and carefully considered any and all clearly enunciated local preferences regarding proposed lease of portion of The Water's Edge Park for a helicopter landing and take off site. Section 2. That the City Council finds that there is no feasible and prudent alternative exists for this use of the park land after holding the public hearing and carefully considering all enunciated local preferences. In addition, the City Council finds that reasonable measures will be taken to protect the park land. Section 3. That the City Manager or designee is authorized to execute a 17-month agreement with Espejo Helicopters, LLC for use certain area of The Water's Edge Park located in Corpus Christi, Texas, to conduct its non-stop commercial helicopter air tours within 25 statute miles and to serve as its location for takeoff, landing, boarding and temporary business operations to provide recreational sightseeing tours. In consideration for use of the premises, Espejo Helicopters, LLC agrees to pay the City monthly rent as follows: Lessee shall pay City five percent of Gross Revenues.
