BACKGROUND INFORMATION: The seawall on Padre Island exteads some 4152.9 feet pamlle{ to lhe gulf beac~ This seawall which was constructed In the late 1~4~'s pro~ not o~/several co~domi~ complexes'md the Holiday Inn-Pm Island which are located adjacent thereto, bul also provides significant protection, for large portions of the Padre Isles SubdMsion. In the early 1970's, co~t action was instituted by the State of Texas against the seawall azxl the develo~ of the Padre Isles Subdivision In an attempt to force the removal of the seawall. Alter. leng~y legal maneuvering and extensive negotiation, a Judgement was eotemd In the 28th Judicial District Court In Nueces ~ in 1974 which affim~:l Itm right of the seawall to remain In place. Included within that Judgemen[ was a ruling that ~ public beach would be at least 200' wide exleflding to at least to the tee of the seawall (at that time. lite beach in front of the seawall was some 400 feet wtde). Over the years, there have been changes In beach condiUons with the beach signlficanUy nan'owing In front o~ the seawall. These beach changes, together w;G~ stopped all development on lhe seawall, U~refa-e drastically reducing the appraisal roll values of ~ property behind the seawall. Over the last four years, City staff has worked bo{h formally and Informally wilh a number of Individuals and groups including seawall owmrs, the Wave Riders, the League of Womea Volers, and the Coastal Bend Sien'a Ck~, as well as Ihe Attorney Generars Off-me and our local legislative deleg~Jon In attempUng to obtain some ala-~ the seawall. As e result ofthese efforts, the Texas Legislature enacted Senate BB 1688 d~lng Ihe 1995 legislaUve session. TITLE: ADC shall furnish to the City at AD¢'s m~mn~m an Owner's Policy of Title Insurance (the "Title Policy") lseu~ by SAN JACINTO TITLE COMPANY (the "Title Company') in the amount of the Sales Price and dated at or within thirty (30) da~ after funding, insuring the city's fee simple title to the Pro~z~y to be good a~d indefeasible subject only to those title exceptions permitted herein, or as may be approved by the City in writinq, and the standard printed exceptions contained in the usual foL'm of the Title Policy; provided, however, that the exception as to restrictive covenants shall only list those exceptionm listed on Exhibit B or as otherwise approved by the City Manager ~ the exception as to taxes shall be limited to taxes for the current year not yet due and payable and subsequent years, and ~ubeequant assessments for prior years due to changes in land u~age or ownership. 7. TITLE AND SURVEY APPROVAL.' ADC shall cause to be delivered to the City within ten (10) days after the effective dat~ of ~his Agreement a Com~it~snt for Title Insurance (the Commitment) and legible copies of all recorded instrtment~ affecting tho Property and recited as exceptions in the Co~itment. If the City ·akes obJsotion to items disclosed in the Co~ent or instruments, which ere not recited on Exhibit B, ADC shall have five (5) days after reoeipt of such objections to curs Isle. If the objections ars not ~atisfied, this Agreement shall ter~inate, unless the City elects to waive the unsatisfied obJsc~ions and co~plst~ the purchase.
