SUPPORTING DOCUMENTS: Ordinance 1 Ordinance canvassing returns and declaring the results of the General Election held on November 6, 2018 in the City of Corpus Christi for the purpose of electing the Mayor and eight Council Members; and of the Special Election on that same date for the adoption of six propositions; making appropriate findings; and declaring an emergency. Whereas, the City Council of the City of Corpus Christi, by Ordinance No. 031500 on August 14, 2018, ordered and called a General Election for the election of Mayor and eight Council Members to be held on November 6, 2018; Whereas, Ordinance No. 031500 provided that a runoff election shall be held on December 18, 2018, if one is necessary; Whereas, by Ordinance No. 031505 on August 14, 2018, the City Council also ordered and called a Special Election concerning six propositions for issuance of bonds in the aggregate principal amount not to exceed $96,000,000 and levying a tax in payment thereof, with priority given to projects identified in each proposition; Whereas, the General Election and Special Elections described above are herein referred to as the “Elections”; Whereas, notice of said Elections was given as required by law; Whereas, said Elections were duly held on the 6th day of November, 2018, at which said contests and measures were presented to the voters as provided in the respective City ordinance calling the applicable Elections and in conformity with the election laws of the State of Texas and the results of said Elections have been certified and returned by the judges and clerks thereof; and Whereas, it is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by the Texas Open Meetings Act; and Whereas, the City Council has reviewed and investigated all matters pertaining to these Elections, and finds that the said Elections were in all respects lawfully held and that the City’s Secretary’s tally and certification of results to the Council are correct; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS THAT: Section 1. The tally of votes cast in the Elections held on the 6th day of November, 2018 made and certified to by the City Secretary of the City of Corpus Christi, attached hereto as Attachment A incorporated by reference and made a part of this Ordinance as though reproduced herein in its entirety, and the same is hereby adopted as the official tabulations of the votes cast at the Elections, and that said tabulations be filed and recorded in the official records of the City of Corpus Christi as the official canvass of the Elections. 2 Section 2. The City Council has diligently inquired into the poll lists and the official Election returns which were duly and lawfully made to the City Council by the judges and clerks holding and conducting such Elections with the poll lists and the official elect ion returns showing separately the votes cast in the Elections. From these returns, the City Council hereby finds that the following votes were cast in the Elections by voters who were resident, qualified voters of the City. The results of the canvass of the Special Elections are declared to be: City of Corpus Christi Proposition A For 47,733 Against 26,729 City of Corpus Christi Proposition B For 47,027 Against 26,788 City of Corpus Christi Proposition C For 46,578 Against 26,667 City of Corpus Christi Proposition D For 45,001 Against 28,212 City of Corpus Christi Proposition E For 50,609 Against 22,570 City of Corpus Christi Proposition F For 43,887 Against 28,955 Section 3. The City Council officially finds, determines, and declares that the Elections were duly and properly ordered, that proper legal notice of the Elections was duly given in the English language and the Spanish language to the extent required by law, that proper election officers were duly appointed prior to the Elections, that the Elections were duly and legally held, that all resident qualified voters of the City were permitted to vote at the Elections, that due returns of the results of the Elections have been made and delivered, and that the City Council has duly canvassed such returns, all in accordance with the laws of the State of Texas and of the United States of America, and the separate ordinances calling the Elections. Section 4. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than 52,000,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition A, the City Council hereby finds and determines that Proposition A carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition A and with law. Section 6. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than 22,000,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition B, the City Council hereby finds and determines that Proposition B carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition B and with law. Section 7. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the author ization and issuance of not more than 5,630,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition C, the City Council hereby finds and determines that Proposition C carried at the 5 Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition C and with law. Section 8. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than 3,878,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition D, the City Council hereby finds and determines that Proposition D carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition D and with law. Section 9. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than 11,343,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition E, the City Council hereby finds and determines that Proposition E carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition E and with law. Section 10. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than 1,149,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition F, the City Council hereby finds and determines that Proposition F carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition F and with law. Section 11. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 12. This Ordinance shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 13. If any provision of this Ordinance or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Ordinance and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Ordinance would have been enacted without such invalid provision. Section 14. It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by Chapter 551, as amended, Texas Government Code. Section 15. This Ordinance shall be in force and effect from and after its final passage and it is so ordained. Section 16. The necessity of making an official canvass of votes and declaring the results thereof immediately in order to meet the requirements of State Law and the City Charter, and the need for efficient and effective administration of the City’s affairs, creates a public emergency 6 requiring the suspension of the City Charter rule that no ordinance be passed finally on the date of its introduction but that such ordinance shall be read at two regular meetings of the City Council, and the Mayor having declared that such emergency exits, having requested the suspension of the City Charter rule that this ordinance be finally passed on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 19th day of November, 2018. 7 Corpus Christi, Texas 19th Day of November, 2018 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance an emergency exists requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council. and shall the City Council be authorized to levy and pledge, and cause to be assessed and collected, within the limitations prescribed by law, annual ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and sinking fund to pay the bonds at maturity and to pay the costs of any credit agreements executed in connection with the bonds?” CITY OF CORPUS CHRISTI PROPOSITION B Shall the City Council of the City of Corpus Christi, Texas be authorized, in accordance with applicable law, to issue and sell one or more series of general obligation bonds of the City, in the aggregate principal amount of not more than 22,000,000, with such series or issues of bonds, respectively, to mature se rially or otherwise within not to exceed forty years from their date and to be sold at such prices and bear interest at such rates (whether fixed, floating, variable, or otherwise, but in no case at a rate that exceeds the maximum rate per annum authorized by applicable law at the time of any such issuance), as shall all be determined within the discretion of the City Council, for the purpose of making permanent public improvements or for other public purposes, to wit: designing, constructing, renovating, improving, reconstructing, restructuring and extending streets and thoroughfares and related land and right-of-way sidewalks, streetscapes, collectors, drainage, landscape, signage, equipment storage facilities, acquiring lands and rights-of-way necessary thereto or incidental therewith (but specifically excluding related City utility costs, which are the responsibility of the City’s utility system), with priority given to the following street projects: Downtown Pedestrian Safety Improvements 12 Downtown Lighting Improvements North Lexington Boulevard, generally from Hopkins Road to Leopard Street Everhart Road, generally from South Padre Island Drive to McArdle Road Alameda Street, generally from Louisiana Street to Chamberlain Street McArdle Road, generally from Carroll Lane to Kostoryz Road Castenon Street, generally from Trojan Drive to Delgado Street Junior Beck Drive, generally from dead end to Bear Lane JFK Causeway Access Road Improvement Airline Road, generally from South Padre Island Drive to McArdle Road Laguna Shores Road, generally from Mediterranean Drive to Wyndale Street South Oso Parkway, generally from South Staples Street to South Oso Parkway Long Meadow Drive, generally from Hunt Drive to St Andrews Drive Other street and utility construction projects with third-party participation in accordance with State law and in providing for the above public improvements, the City Council shall have the option to (i) utilize other funds available for such purposes and (ii) abandon such indicated public improvements that are reliant, in part, on external sources of funding that (for whatever reason) do not materialize or because unforeseen changes in fact or circumstance make the anticipated expenditure no longer wise or necessary (as determined by the City Council), and after making due provision for the improvements listed above or determining that the public improvement project will not proceed for a reason heretofore described, the City Council may, in its discretion, use any excess funds for constructing, reconstructing, restructuring, and extending other streets and thoroughfares and related land and right-of-way sidewalks, streetscapes, collectors, drainage, landscape, signage, equipment storage facilities, acquiring lands and rights-of- way necessary thereto or incidental therewith (but specifically excluding related City utility costs, which are the responsibility of the City’s utility system); and shall the City Council be authorized to levy and pledge, and cause to be assessed and collected, within the limitations prescribed by law, annual ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and sinking fund to pay the bonds at maturity and to pay the costs of any credit agreements executed in connection with the bonds?” CITY OF CORPUS CHRISTI PROPOSITION C Shall the City Council of the City of Corpus Christi, Texas be authorized, in accordance with applicable law, to issue bonds of the City, in one or more series or issues and in the aggregate principal amount of $5,630,000, with such series or bonds, respectively, to mature serially or otherwise within not to exceed forty years from their date and to be sold at such prices and bear interest at such rates whether fixed, floating, variable, or otherwise, but in no case at a rate that exceeds the maximum rate per annum authorized by applicable law at the time of any such issuance), as shall all be determined within the discretion of the City Council, for the purpose of making permanent public improvements or for other 13 public purposes, to wit: designing, constructing, renovating, improving, expanding, and equipping City parks and recreation facilities, with priority given to the following projects: Senior Centers Recreation Centers Park System Playgrounds Oso Pool Aquatics Center Greenwood Sports Complex Cole Park and Dimitt Piers Other parks and recreation projects with third-party participation and in providing for the above public improvements, the City Council shall have the option to (i) utilize other funds available for such purposes and (ii) abandon such indicated public improvements that are reliant, in part, on external sources of funding that (for whatever reason) do not materialize or because unforeseen changes in fact or circumstance make the anticipated expenditure no longer wise or necessary (as determined by the City Council), and after making due provision for the improvements listed above or determining that the public impr ovement project will not proceed for a reason heretofore described, the City Council may, in its discretion, use any excess funds for designing, constructing, renovating, improving, expanding, and equipping City parks and recreation facilities; and shall the City Council be authorized to levy and pledge, and cause to be assessed and collected, within the limitations prescribed by law, annual ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and sinking fund to pay the bonds at maturity and to pay the costs of any credit agreements executed in connection with the bonds?” CITY OF CORPUS CHRISTI PROPOSITION D Shall the City Council of the City of Corpus Christi, Texas be authorized, in accordance with applicable law, to issue bonds of the City, in one or more series or issues and in the aggregate principal amount of $3,878,000, with such series or bonds, respectively, to mature serially or otherwise within not to exceed forty years from their date and to be sold at such prices and bear interest at such rates whether fixed, floating, variable, or otherwise, but in no case at a rate that exceeds the maximum rate per annum authorized by applicable law at the time of any such issuance), as shall all be determined within the discretion of the City Council, for the purpose of making permanent public improvements or for other public purposes, to wit: designing, renovating, improving, expanding, and equipping City libraries and cultural facilities, with priority given to the following projects: Libraries Museum of Science and History Art Museum of South Texas 14 Heritage Park Historical Houses and in providing for the above public improvements, the City Council shall have the option to (i) utilize other funds available for such purposes and (ii) abandon such indicated public improvements that are reliant, in part, on external sources of funding that (for whatever reason) do not materialize or because unforeseen changes in fact or circumstance make the anticipated expend iture no longer wise or necessary (as determined by the City Council), and after making due provision for the improvements listed above or determining that the public improvement project will not proceed for a reason heretofore described, the City Council may, in its discretion, use any excess funds for designing, constructing, renovating, improving, expanding, and equipping City library and cultural facilities; and shall the City Council be authorized to levy and pledge, and cause to be assessed and collected, within the limitations prescribed by law, annual ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and sinking fund to pay the bonds at maturity and to pay the costs of any credit agreements executed in connection with the bonds? CITY OF CORPUS CHRISTI PROPOSITION E Shall the City Council of the City of Corpus Christi, Texas be authorized, in accordance with applicable law, to issue bonds of the City, in one or more series or issues and in the aggregate principal amount of $11,343,000, with such series or bonds, respectively, to mature serially or otherwise within not to exceed forty years from their date and to be sold at such prices and bear interest at such rates whether fixed, floating, variable, or otherwise, but in no case at a rate that exceeds the maximum rate per annum authorized by applicable law at the time of any such issuance), as shall all be determined within the discretion of the City Council, for the purpose of making permanent public improvements or for other public purposes, to wit: designing, constructing, renovating, improving, expanding, upgrading and equipping City public safety facilities, with priority given to the following projects: Police Radio Communication System Police Headquarters Police Substations Fire Headquarters & Emergency Operations Center EMS Central Building Fire Department Warehouse Fire Stations and in providing for the above public improvements, the City Council shall have the option to (i) utilize other funds available for such purposes and (ii) abandon such indicated public improvements that are reliant, in part, on external sources of funding that (for whatever reason) do not materialize or because unforeseen changes in fact or circumstance make the anticipated expenditure no longer wise 15 or necessary (as determined by the City Council), and after making due provision for the improvements listed above or determining that the public improvement project will not proceed for a reason heretofore described, the City Council may, in its discretion, use any excess funds for designing, constructing, renovating, improving, expanding, and equipping City public safety facilities; and shall the City Council be authorized to levy and pledge, and cause to be assessed and collected, within the limitations prescribed by law, annual ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and sinking fund to pay the bonds at maturity and to pay the costs of any credit agreements executed in connection with the bonds? BACKGROUND The Council canvassed the results of the November 6, 2018 general election. In the Mayoral and Council Member District One, Two, Three, and Five races, none of the candidates received a majority vote. Per the City Charter, the candidates receiving the highest and second highest number of votes enter a runoff election. The runoff election is scheduled on December 18, 2018. Nueces County participates in the Countywide Polling Place Program under Election Code Section 43.007 as amended, meaning that any qualified registered voter of the City of Corpus Christi can vote in the election at any polling place identified in Attachment A. Thepolls shallbeopenfrom7:00 amto7:00p.m. on the dayof the election. SECTION 6.The City Secretary shall conduct the election as directed by Ordinance of the City Council and by law. SECTION 7.Early voting for the election in person may be conducted at the times and locations of the temporary branch polling places set forth on Attachment B to this Ordinance hereto incorporated by reference and made part of this ordinance. The City Secretary is authorized, in theeventofanemergency,preventinganyofthedesignatedpollingplaces frombeing utilized, to provide for suitable replacement locations. SECTION 8.The City Secretary is directed to post and publish such election notices as are requiredbythe ElectionLaws ofthe Stateof Texas.The CitySecretaryis furtherappointedasthe authority and officer responsible for the conduct of said election and is hereby authorized and directed to make all necessary arrangements for the holding of said election in accordance with and subject to the laws of this Stateincluding butnotlimitedtocoordinatingtheelectionprocess, tabulation equipment, and supplies in accordance with the election agreement to be executed with Nueces County. The CitySecretaryisauthorizedtoapprovealllawfulchangesandadditions to the procedures provided herein in order to implement such agreement, including, but not limited to provisions for substations. SECTION9.Ifforanyreasonanysection,paragraph,subdivision,clause,phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, work, or provision of this ordinance, for it is the definite intent of this City Council that everysection,paragraph, subdivision, clause, phrase,word, or provision hereof be givenfullforce and effect for its purpose. SECTION 10.The fact that it is necessary and essential that the governing body of the City of Corpus Christi order the runoff election, that the notice of such election should be promptly posted and published, that the City runoff election shall be held on December 18, 2018, and immediate action is necessary for the efficient and effective administration of the city'saffairs, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance shall be passed finally on the date of its introduction but that such ordinances shall be read on emergency reading. The City Council hereby (1) finds that suchemergencyand necessitydoexist due to the need for immediate action necessary for the efficient and effective administration of the City’s runoff election and (2) suspends the Charter rule that requires consideration of and voting upon ordinances at two regular meetings so that this ordinance is passed and takes effect upon first reading as an emergency measure on this 19th day of November, 2018.
