Saldana, AICP, City Planner Erma Ramirez, Recording Secretary CALL TO ORDER Chairman Mahaffey opened the public hearing at 1:35 p.m. in the Council Chambers at City Hall and explained the procedure to be followed. David Clay: Appeal No. ZBA0702-01 Request: A special yard exception to encroach 25 feet into the 50-foot front yard setback on King Estates Unit 2, Block 2, Lot 3, located on the southwest corner of King Lane and King Trail. Board Member Alvarado requested that he be excused from hearing the zoning case because he resides in the area. Mr. Saldana stated that the appellant, Mr. David Clay, is requesting a special yard exception to encroach 25 feet into the 50-foot front yard setback to extend the building of his home. He described the surrounding land use stating that to the west of the subject property is an existing single-family residence. Across King Lane the property is undeveloped and to the east side of King Trail it is also undeveloped. He stated that the subject property is a triangular corner lot, which has a 50-foot yard requirement on both side streets. He presented a computerized slide presentation of the subject property and surrounding area, and also a site plan provided by the appellant. Nine (9) notices were mailed to property owners within a 200-foot radius, of which none were returned in favor or in opposition. Mr. Taylor Mauck, Island Architects, stated that the property has one (1) front yard and the other is a side yard. When originally platted, an error was made calculating 50 feet on one side and 25 feet on the other. SCANNED Board of Adjustment Minutes • July 24,2002 Page 2 Mr. Saldafia stated that even though it is platted as 25 feet, zoning still requires a 50-foot setback on both sides. According to the Zoning Ordinance, they are required to have two(2) front yards if on a corner lot. Mr. David Clay, owner of the subject property, stated that his neighbors approved of the encroachment. Chairman Mahaffey opened the public hearing. No one appeared in favor or in opposition, therefore, the public hearing was closed. Mr. Saldafia stated that Staff recommends approval of the special yard exception along King Trail, limited to the encroachment of the residence as shown on the site plan. Motion by Board Member McDonald, seconded by Clancy, that the request be approved limited to the encroachment of the building as per the site plan. Approval of the special yard exception will require the replatting of Lot 3 to show the encroachment. Motion passed unanimously. APPROVAL OF MINUTES The minutes for the June 26, 2002 meeting were approved as written. OTHER MATTERS Motion by Alvarado, seconded by Martinez, that the proposed bylaws be approved as amended during the workshop meeting held earlier in the day.
