HomeMy WebLinkAboutC2005-029 - 2/8/2005 - ApprovedCORPUS CHRISTI TRAFFIC ENGINEERING SERVICES CONTRACT FOR ENGINEERING SERVICES The City of Corpus Christi, Texas, hereinafter called "City', and Wilbur Smith Associates, Inc hereina[ter called "Consultant", hereby agree as follows: I. SERVICES TO BE PERFORMED The Consultant hereby agrees, at his/her own expense, to perform all architectural/engineering services necessary to reseamh, document, design, prepare plans, specifications, reports, recommendations, bid and contract documents to perform the services described as follows. ti. SCOPE OF SERVICES The Consultant's services will include basic research, documentation and design necessary for the preparation of plans and specifications required for traffic engineering services and activities. The Consultant, in the performance of this contract, will exercise usual and customary professional care in Consultant's efforts to comply with the applicable codes and regulations of City, State, and other Federal authorities having jurisdiction including applicable fire codes, life safety codes, health regulations, Texas Department of Insurance Windstorm Protecl~on requirements, the Americans with Disabilities Act, the Texas Department of Licensing and Regulation, Elimination of Architectural Barders Program (Article 9102), the Texas Trench Sa[ety Act, and the Storm Water Retention Act. The Consultant will include in the technical specifications a section entitled Trench Safety which will incorporate by reference the legislation relating to the Texas Trench Sa[ety Act. The Consultant will coordinate design activities and design elements with City staff and other Consultants as directed by the City. The Consul/ant will work cooperatively with citizens, local organizations, City staff, elected officials and others. Services will include presentations to Council when required, which will be combined with other meetings on site local work when possible. BASIC SERVICES Through this Agreement, Consultant personnel will effectively function as/he City's Traffic Engineer and be responsible for fulfilling all administrative and technical duties assigned to this official under the City's zoning ordinance, with the exception of the Traffic Engineer's personnel, accounts payable and municipal civil service i:unclions. The City will retain lead responsibility for personnel, accounts payable and municipal civil service functions, with support from Consultant as outlined later in this Agreement. On-Site Work Priorities Upon execution of this Agreement, Consultant personnel will spend up to sixteen (16) person-hours on site at City Hall during two consecutive days approximately once per month. Priorities for the on- site time will include: · Review and recommend treatments [or Speed Zones for hospitals and schools and other street locations; · Review the safe routes to schools program in coordination with local school safety officers; · In concert with the Development Services Department, review subdivision and site development proposals for traffic and thoroughfare impacts; · Review requests for the public to address local traffic speeds, cut through traffic, access and circulation, and other traffic issues; · Review the efficiency of current traffic signals and signal systems and recommend course of action for improvement; 2005-029 a Services 02/08/05 M2005-042 ;contract2.005.doc Wilbur Smith Associates · Review and recommend intersection approach improvements and congestion relief improvements; · Assist in the development of project scope for the 2004 Bond issue; · Prepare traffic control and safety plans for City construction projects as requested. · Being available to meet with scheduled and walk-in development applicants and/or their agents, as well as citizens, to explain and respond to questions regarding the City's traffic and parking ordinances and programs; · Review and recommend accident tracking and reporting software to replace the TRASER system in use; Prepanng necessary written reports from the Traffic Engineer on traffic-related items. These reports will be forwarded to the relevant Committee or Council prior to its meeting/hearing. In preparing the initial reports, Consultant will develop standard formats for providing the Traffic Engineer's review findings and comments to City Committees and Council and to applicants. Consultant sta['f will also be responsible for coordinating with the City Attorney, as necessary, in preparing the Traffic Engineer's wdtten findings; Preparing verbal presentations to the Transportation Advisory Committee and the City Council to overview subject issues (including preparing any necessary maps/graphics to depict particular property and/or land use situations); identify the Traffic Engineer's comments, conclusions and issues lor official consideration; and, address questions or concerns of the applicant and/or City Committees and Council; Assisting City staff to set up appropriate filing/tracking systems for all traffic-related matters. Review current in-house traffic engineering capabilities and recommend modifications such as new software to enhance the efficiency and range of current in-house capabilities. Beginning a staff training process for selected City staff to cover all aspects of zoning administration, starting with the basics of the City's adopted ordinance, zoning applications and procedures, and responding to citizen questions; then continuing with handling requests for zone changes and variances, coordinating review activities among City staff, preparing staff comments and recommendations, and filing and tracking zoning cases. The days and times during which Consultant personnel will be on site at City Hall will be set on a monthly basis to allow flexibility in scheduling for both the City and Consultant. This will include determining ii: any on- site time will be completed during weeks in which major holidays fall. Off-Site Technical Assistance During the portion of each week when Consultant personnel are not working on site at the City, they will be available to provide technical assistance and support dudng normal business hours (8:00 a.m. to 5:00 p.m., Monday through Friday) to respond to inquiries (by telephone, fax or e-mail) and to provide "quick response" answers to time-sensitive questions that adse pertaining to zoning-related matters. Depending upon the complexity of each assistance request or inquiry, Consultant will assign an Associate, Senior or Principal Planner as appropriate. Council and Transportation Advisor? Committee Meetinqs Transportation Advisory Committee. Each month, CONSULTANT personnel will attend, as needed, meeting(s) of the Transportation Advisory Committee to present any traffic-related staff reports and to address comments and questions of citizens and members of the committee. City Council. Each month, Consultant personnel will attend, as needed, City Council meeting(s) that involve traffic-related agenda items and/or public hearings. Consultant personnel will not be responsible for preparing meeting minutes but will be available to review and offer suggested revisions on draft minutes prepared by City staff. Consultant personnel will also assist in finalizing the meeting packets for any Commission or Board meeting that involves traffic-related agenda items. Such meeting packets are copied, assembled and distributed by City staff. Consultant's role will be to provide input on meeting agendas, prepare any necessary reports [rom the Traffic Engineer on traffic-related items, and review the meeting materials related to such items to ensure that all necessary information is included. ADDITIONAL SERVICES - The City Engineer may direct that additional services be undertaken by the Consultant provided that such services do not result an increase in the total authorized fee. If such additional services require an increase in the authorized fee, the authorization will be evidenced in wdting as an amendment to this contract POINT OF CONTACT - The City Engineer will designate a single point of contact for all communications, in[ormation and documents to pass through. Any actions taken by the Consultant on instructions, information or concurrence provided by or through any other source will not be compensated under this contract. ORDER OF SERVICES - Consultant agrees to begin work immediately after written authorization from the City Engineer. The Consultant is also authorized to proceed with services listed in this contract and such additional services as may be directed by the City Engineer. The anticipated term of services is February 1, 2005 through July 31, 2005. The duration of services may be extended beyond July 31,2005 by mutual agreement. Any extension reduidng an increase in the authorized fee will be evidenced in wdting as an amendment to this contract. The City Engineer will endeavor to provide a minimum of two (2) weeks notice to the Consultant for public hearings/meetings to permit proper preparation including development of reports, memorandums, tables, graphics, and other information. The City Engineer will provide a prompt response to the Consultant for guidance, direction, or approval of all work submitted in the various phases. III. FEES AUTHORIZED The City will pay the Consultant a total not to exceed fee of $29,750.00. This fee will be tull and total compensation for services provided and expenses incurred in performing the tasks specified as basic, construction, and post-construction phase services specil~ed in Section II. The fee is based on the houdy rates and expense schedule attached as Schedule of Fees (Exhibit "A"). Consultant will be compensated for airfare, ground transportation, lodging, and per diem meal expenses incurred due to out-of-town travel on a not to exceed basis as set forth in the Summary of Fees. Travel will be will be documented by photocopies of receipts and invoices. The table "Summary of Fees" shall be used when calculating the fee due for the proportion of services completed. The City shall make prompt payments in response to Consultant's statements for Professional Services. Billing for services provided will be based on the Consultant's actual time and expenses completed at the time of billing. Consultant will submit monthly statements for work authorized by the City Engineer and performed by the Consultant. The City will make prompt monthly payments in response to Consultant's monthly invoices. All invoices shall be accompanied by a cover letter summarizing the fee in accordance with the Summary Schedule of Fees. Invoices will be sequentially numbered for each project and state the project name. The letter shall state the number of the current invoice, the contract fee for each task, the amount previously Contract for Architectural/Engineering Services. Invoices will be organized to accommodate funding sources. Dudng the construction phase, the Architect~Engineer will also submit a bdei: lettedmemo summarizing observations during the site visit, the work of the contractor, construction progress for the billing pedod, and any pending items. IV. TERMINATION OF CONTRACT The City Manager or Consultant may, at any time, with or without cause, terminate this contract upon seven days written notice to the Consultant at the address specified below. If termination occurs pdor to the final completion of all work contemplated by this contract, the Consultant shall be paid a reasonable compensation for the services actually rendered in accordance with the above-described schedule of fees and in proportion to the amount o[ work done on such stages or phases as have been authorized. The foregoing shall not be construed Io require the City Manager to compensate the Consultant for any services not performed in a proper, professional manner. V. Vlt. OWNERSHIP OF DOCUMENTS All documents including contract documents (plans and specifications), record drawings, contractor's field data, and submittal data shall upon payment of all fees and reimbursable expenses owed under this agreement, be the sole property oi: the City. Those documents may be used by the City Engineer for other City projects, and with the exception of standard details that are not specific to this project may not be used again by the Consultant without the express wdtten consent of the City Engineer. The City will assume sole liability for adsing out of any reuse or modification of the Consultant's documents, except where the Consultant is found to be liable by a court or forum of competent jurisdiction. VIII. CORRECTING MA'I-FERS Any ext/a cost and expense necessary to correct matters caused by failure of the Consultant or his/her sub- consultants to exercise a reasonable degree of professional care will be paid by the Consultant and not reimbursed by the City. IX. No part of the Consultant's fee may be assigned in advance of receipt by the Consultant without written consent of the City, The City shall not pay the fees of expert or technical assistance and consultants unless such employment, including the rate of compensation, has been approved in writing by the City. X. INSURANCE The Consultant will submit to the City Engineer a certificate of insurance, with the Cib/named as additionally insured, showing the minimum coverage set forth in Exhibit "B" by an insurance company acceptable to the city. Xl. DISCLOSURE OFINTEREST In compliance with City o¢ Corpus Christi Ordinance No. 17112, Consultant agrees to complete the City of Corpus Christi Disclosure of Interests form which is incorporated in the contract as Exhibit "C".
